    GENERAL STATEMENTSUniversities Australia is the peak body representing the Australian university sector and is acompany incorporated under the Copomtions Act 2001 (Cth). I t was formed out o f theAustralian Vice-Chancellors' Co mm ittee (AV CC ) in May 2007 and 38 o f Australia's universitiesare members o f the company.

    The Gove rnmen t o f the Republic o f Chile as represented by th e Minister for Foreign Affairs, M rAlejandro Foxley is responsible fo r the impleme ntation o f this M emo randum through it s variousMinistries, ofices and the Bicentennial Co mm ittee for Human Capital Developm ent.An Australia - Chile Free Trade Agreement (FTA) will be signed in July 2008 fo r m utua limplementation from I January 2009. This FTA includes a chapter on cooperation that statestha t b ot h countries agree t o establish a framework fo r cooperative activities as a means t oexpand and enhance the benefits o f the FTA.Further, the Australian Department of Education, Employment and Workplace Relations andthe Chilean Ministry o f Education are signatories t o a M emo randum o f Understanding (MoU)on cooperation in the fields of education and training. That MoU, signed in April 2004, outlinesthe intent o f both parties t o encourage and facilitate the developm ent of contacts andcooperation between government agencies, educational institutions and other bodies for theconduct o f cooperative activities.In line with the FTA and Mo U, the Gove rnment o f the Republic o f Chile and UniversitiesAustralla (hereinafter referred t o as the Parties) wish t o enhance cooperation between theirtwo countries under the Chilean Bicentennial Fund in the interests of promoting highereducation in b oth countries.

    Acknowled ging friendships and excellent bilateral relations;

    Recognising a long standing relationship between the Chilean Government and the AustralianGovernm ent and the need to strengthen cooperation under the Chilean Bicentennial Fund fo rhuman capital development;Considering this Memorandum of Understanding complements the existing Government-to-Governm ent agreements on cooperation between bo th countries;

    The Parties agree the following:

    Article I

    PURPOSEI . Under this M emorandum the Parties agree t o pro mo te cooperation and w ork togethert o increase access fo r Chilean students to masters, doc tora l, internship and postdo ctora lstudies in Australian universities. This Memorandum complements the Free TradeAgreement and Governm ent-to-Governm ent agreement on cooperation in the ,field ofeducation betwe en Chile and Australia.

    1.2 Australian universities will be invited t o negotiate individual agreements with the ChileanGovernm ent through its representatives in Australia. These individual agreements will beincluded in a Register of Agreements.

    1.3 All member institutions of Universities Australia shall be eligible for consideration asparticipants in the program o f cooperative activities.

    Article II

    FIELDS OF COOPERATION

    2.1 The Parties will cooperate in relation t o scholarships and student exchanges in thefollowing fields o f study and training:PhD and Masters studies;Graduate Internship and Fellowship programs;Jo int research programs;

    Postdoctoral programs; andEnglish teacher training.

    2.2 Priority fields o f study fo r Chilean scholarship recipients and join t research programscould include among others: Mining, Agriculture and Food Industry, Aquaculture andFishing, Tourism and Hospitality, Biotechnology, Information and CommunicationTechnologies, Energy, Environmental Issues, Health, Education, Housing and PublicSecurity.

    2.3 Further fields o f cooperation may be added by m utual written consent o f the Parties.

    Article Il lCHILEAN BICENTENNIAL FUND SCHOLARSHIP PROGRAM

    3.1 The Chilean Gove rnment has created the Bicentennial Fund to improve the quality o fhigher education. In response to th e Chilean Gove rnment's desire t o increase accessand pro mote equal opportun ities t o Chilean students t o advanced degree studies inAustralia, the Parties have established a scholarship program, known as the "CHII-E-UNIVERSI-I'IES AU ST RA LIA Co op era tion in Hu ma n Capital Developme nt Program",(hereinafter the "Program").

    3.2 The Program will emphasise Chile's need to strengthen human capital developm ent andimprove the scope and quality of education, scientific & technological research andinnovation, in areas associated with i t s socio-economic development.

    3.3 It is an objective o f the Program to grant up to 500 scholarships t o Chilean students t ostudy o r un dertake research in Australia pe r year.

    3.4 Un der the Bicentennial Fund, the Gove rnmen t of Chile will:(a) Determ ine annually, in collaboration with the Steering Comm ittee, and after thescholar selection process, the num ber o f scholarships t o be aw arded in Aus traliaduring the following academic year.(b) Meet the costs o f living expenses for scholarship ho lde n while enrolled inAustralia.(c) Fund university tui tion and fees fo r scholarship ho lders n o t granted funding fro mAustralian universities.(d) Provide the roundtrip air ticket (economy) fro m Chile to the correspondingdestination in Australia, fo r each scholarship holde r.(e) Fund English language training courses in Chile for scholarship holders who do

    not meet the language entrance requirements established by the relevantAustralian university.

    (9 Provide up t o six months allowances fo r living expenses fo r scholarship holderswho require full time English language proficiency courses in Australia.(g) Cover administrative costs incurred for selection, data processing, supervisionand mo nito ring o f scholarship holders.(h) Cover additional expenses of the scholarship holders and/or their dependentsthat th e Chilean Gove rnment m ight deem necessary.

    3.5 Universities Australia throug h the Steering Co mmittee and its mem ber universities will:(a) Following the selection process under the Program, determine each year, incollaboration with the Bicentennial Committee for Human CapitalDevelopment, the number of university places in Australia available under theProgram fo r the following academic year.(b) Subject t o Australian laws and regulations, provide scholarship holders and theirdependents wit h access t o accurate information o n student visas required fo rentry into, and t o enable studying in, Australia.(c) Seek supp ort fro m memb er universities t o include in the ir individual annexagreements t o fully cover o r subsidise tui tion and fees for students in theProgram.(d) Seek support from member universities to include in their individual annexagreements supervision and monitoring of participants, including academic

    progress, visa compliance and emergencies.(e) Supply guidance as needed and available t o participants t o make thei rapplications t o Australian Universities.(9 Seek support from member universities t o include in the ir individual annexagreements health insurance cover for participants and their dependents, inaccordance with Australia requirements, laws and regulations.(g) Seek support fro m member universities t o include in the ir individual annexagreements cover for a maximum of six months' English language proficiencycourses in Australia fo r scholarship recipients wh o may need training t o

    improve the ir proficiency prio r to beginning the ir academic programs.

    Article IVIMPLEMENTATION

    4.1 The Parties will implement this Memorandum of Understanding via a SteeringComm ittee th at w ill convene periodically in order to evaluate and serve as an advisorybody w ith regard t o the implementation o f this Memorandum o f Understanding.Mem bership of the Steering Com mittee will be determ ined by the Parties bu t should ata minimum include: one representative of the Ministers of Education of Chile; onerepresentative of Universities Australia, the Executive Officer o f the Chilean BicentennialCo mm ittee fo r Hum an Capital Development; representatives o f the Chilean ScholarshipProgram Agencies; a representative of the Chilean Ministry of Foreign Affairs andrepresentatives o f Australian universities.

    4.2 Meetings o f the Steering Com mittee shall be h eld in Australia o r C hile as agreedbetw een the Parties.

    4.3 Universities Australia through the Steering Co mm ittee shall:(a) Identify appropriate study and research programs in accordance with Chilean andAustralian requirements;(b) Supp ort informa tion dissemination activities related t o the Program including

    recruitment: and(c) Provide inform ation as requ ired and as available fo r scholarship ho lde r placem ent,enro lment and associated procedures, subject t o privacy obligations und erAustralian law.

    Article VGENERAL

    Duration and termination5.1 This Memorandum o f U nderstanding shall be valid f o r 5 years from the date o f signing,and after the expiry o f that time, unless otherwise arranged betwee n the Parties, it w illremain effective fo r ano ther pe riod o f five years. Each Party may term inate thisMemorandum of Understanding by giving the other Party 60 days n otice o f tha tintention.

    5.2 Amendm ents t o this Mem orandum o f Understanding shall take effect on w rittenagreement between the Parties.

    5.3 This M emorandum o f Und erstanding has been draw n up in English and Spanish. Bothtexts are equally valid.

    Costs

    5.4 Each Party is t o bear the ir o wn costs o f drafting, signing and complying with th e terms o fthis Memorandum of Understanding, including any legal, interpretive and travelexpenses.

    Notice5.5 A notice must be:

    (a) in writing , signed by a peno n duly authorised by the sender; and(b) hand delivered o r sent b y prepaid post o r facsimile to the recipient's address fornotices specified in clause 5.6 be low , as varied by any notice given by the'recipient t o th e sender.
