Acuerdo entre Ia Republica de Colombia

y las Naciones Unidas, representadas por Ia Entidad de las Naciones Unidas

para Ia lgualdad de Genero y el Empoderamiento de las Mujeres (ONU Mujeres), sobre el establecimiento de Ia Oficina de ONU Mujeres en Colombia

CONSIDERANDO que Ia Asamblea General de las Naciones Unidas, en su resolucion 64/289, del 21 de julio de 2010, decidio crear Ia Entidad de las Naciones Unidas para Ia lgualdad de Genera y el Empoderamiento de las Mujeres (ONU Mujeres), consolidando y transfiriendo a este organismo los mandates, funciones y recursos existentes, incluidas las instalaciones, infraestructura y responsabilidades, de Ia Division para el Adelanto de Ia Mujer (DAW), el Institute lnternacional de Investigaciones y Capacitacion de las Naciones Unidas para Ia Promocion de Ia Mujer (INSTRAW), Ia Oficina del Asesor Especial del Secretario General en Cuestiones de Genera y Adelanto de Ia Mujer (OSAGI) y el Fonda de Desarrollo de las Naciones Unidas para Ia Mujer (UNIFEM), de manera que actue como secretarfa y lleve a cabo actividades operativas de alcance nacional.

POR TANTO, ONU Mujeres y el Gobierno, denominados conjuntamente como "Partes" e individualmente como "Parte", firman el presente Acuerdo en un espfritu de cooperacion amistosa, y acuerdan lo siguiente.

Articulo I Definiciones

A los efectos de este Acuerdo ,

1. "Estado Anfitri6n" hace referenda a Ia Republica de Colombia;

2. "Gobierno" hace referencia al Gobierno de Ia Republica de Colombia;

3. "Las Partes" hace referenda a ONU Mujeres y al Gobierno de Ia Republica de Colombia;

4. "La Convenci6n General" hace referencia a Ia Convencion sabre Privilegios e lnmunidades de las Naciones Unidas, aprobada par Ia Asamblea General el 13 de febrero de 1946 y respecto de Ia cual Colombia deposito su instrumento de adhesion el 6 de agosto de 197 4;

5. "EI Secretario General" hace referenda al Secretario General de las Naciones Unidas;

6. "Oficina" hace referencia a las Oficinas de Ia Entidad de las Naciones Unidas para Ia lgualdad de Genera y el Empoderamiento de las Mujeres (ONU Mujeres en Colombia) ;

7. "Jefe/a de Ia Oficina" hace referencia al funcionario/a designado/a Jete/a de Ia Oficina de Ia Entidad de las Naciones Unidas para Ia lgualdad de Genera y el J\ Empoderamiento de las Mujeres (ONU Mujeres). ~~\ [

8. "Funcionarios/as de Ia Oficina" hace referencia a los/as funcionarios/as asignados/as a Ia Oficina de Ia Entidad de las Naciones Unidas para Ia lgualdad de Genera y el Empoderamiento de las Mujeres (ONU Mujeres) , empleados/as de acuerdo con el Reglamento y Estatuto del Personal de las Naciones Unidas, a excepcion del personal contratado de forma local que trabaje por horas con arreglo a Ia resolucion 76 (1) de Ia Asamblea General de las Naciones Unidas, del 7 de diciembre de 1946.

9. "Expertos/as en Misi6n" hace referencia a aquellas personas distintas de los/as Funcionarios/as de Ia Oficina que realizan misiones a peticion de Ia Oficina o en nombre de ella;

10. "Autoridades competentes" hace referencia a las autoridades centrales , locales ode otro ambito que se encuentran bajo Ia jurisdiccion del Estado Anfitrion ;

11 . "lnstalaciones de Ia Oficina" hace referencia a los edificios o partes de los edificios y terrenos pertenecientes a estos, ocupados de forma permanente o temporal por Ia Oficina, tal como se determina en el articulo VI del presente Acuerdo o en otro Acuerdo Suplementario, o a las instalaciones en que Ia Oficina celebra las reuniones que convoca, junto con las instalaciones y los complejos que Ia Oficina ocupa, mantiene o utiliza;

12. "Archivos de Ia Oficina" hace referencia a todos los registros, correspondencia, documentos, manuscritos, archives de datos, imagenes fijas y animadas y grabaciones de audio y video que pertenezcan a Ia Oficina;

13. "Propiedad de Ia Oficina" hace referencia a todos los bienes, incluidos los fondos, haberes o ingresos, que pertenecen a Ia Oficina o que esta custodia o administra;

14. "Telecomunicaciones" hace referencia a toda emision , transmision o recepcion de informacion oral o escrita , imagenes, audio o informacion de cualquier tipo , por cable , radio, satelite, fibra optica u otro media electronico o electromagnetico.

Articulo II Objeto y Alcance del Acuerdo

Por el presente Acuerdo se establecen los mecanismos necesarios para el desempeno eficiente del mandata, las funciones, responsabilidades y recursos de Ia Oficina, ademas de regir Ia situacion de sus instalaciones, Funcionarios/as y Expertos/as en Mision .

Articulo Ill Aplicaci6n de Ia Convenci6n General

La Convencion General sera aplicada a Ia Oficina, sus bienes, fondos y haberes, asi como a los/as Funcionarios/as y Expertos/as en Mision , de acuerdo con lo dispuesto en el Articulo I del presente Acuerdo.

Articulo IV Funciones de Ia Oficina

La Oficina llevara a cabo las siguientes funciones en el Estado Anfitri6n , entre otras:

(a) Contribuir a los esfuerzos nacionales por promover y fomentar Ia igualdad de genero y el empoderamiento de las mujeres mediante Ia asesoria en politicas y otorgando apoyo institucional en el desarrollo de iniciativas y programas que favorezcan el progreso hacia Ia igualdad de genero en todas las esferas.

(b) Brindar apoyo tecnico y econom1co a los proyectos y a las iniciativas relacionadas con su mandato.

(c) Desarrollar, en coordinaci6n con el Gobierno, un marco de cooperaci6n estrategica y un programa anual de trabajo con el objetivo de identificar posibles areas de acci6n en funci6n de las caracteristicas geograficas o demograficas.

(d) Promover Ia capacidad y Ia coordinaci6n dentro del Sistema de las Naciones Unidas, asi como entre este y el Estado Anfitri6n, con elfin de contribuir a Ia igualdad de genero y el empoderamiento de las mujeres.

(e) Apoyar Ia aplicaci6n y seguimiento de acuerdos intergubernamentales.

(f) Contribuir a Ia generaci6n de conocimiento sobre Ia igualdad de genero y a Ia difusi6n de buenas practicas al respecto.

(g) Coordinar las acciones del Sistema de las Naciones Unidas en materia de igualdad de genero.

(h) Contribuir a mejorar Ia rendici6n de cuentas del Sistema de las Naciones Unidas mediante Ia transversalizaci6n del enfoque de genero.

(i) Favorecer Ia creaci6n de capacidades en materia de genero entre los distintos actores nacionales.

ONU Mujeres se compromete a mantener informado al Gobierno de los avances logrados como consecuencia de las actividades de divulgaci6n fruto del presente Acuerdo.

Articulo V Personalidad Juridica

La Oficina gozara de personalidad juridica dentro del territorio del Estado Anfitri6n y tendra capacidad juridica para emprender todas las acciones legales necesarias para implementar sus objetivos misionales, inclusive:

a) contratar; b) adquirir y disponer de propiedades, inmuebles y muebles, asi como poseer recursos financieros y disponer libremente de ellos; 0\ \' ~ c) entablar procedimientos judiciales. \ \'t) \

Articulo VI Creaci6n y Composici6n de Ia Oficina

1. La sede de Ia Oficina se establecera en Bogota, D.C., Colombia. La apertura de Oficinas distintas a Ia sede, requerira Ia consulta previa con el Ministerio de Relaciones Exteriores del Estado Anfitri6n , que debera expresar su consentimiento. Las Oficinas gozaran de las mismas condiciones que las establecidas en el presente Acuerdo.

2. ONU Mujeres consultara con el Gobierno antes de aumentar el numero de Funcionarios/as asignados/as a Ia Oficina, mediante comunicaci6n escrita al Ministerio de Relaciones Exteriores del Estado Anfitri6n . ONU Mujeres tamara en consideraci6n las observaciones del Gobierno.

3. El Ministerio de Relaciones Exteriores del Estado Anfitri6n debera ser informado de cualquier cambia en Ia ubicaci6n de Ia Oficina.

Articulo VII lnviolabilidad de Ia Oficina

1. La Oficina y las instalaciones de Ia Oficina tendran caracter inviolable. Los haberes y bienes de Ia Oficina y las instalaciones de Ia Oficina, donde quiera que se encuentren y en poder de quien quiera que sea, gozaran de inmunidad contra allanamiento, requisici6n , confiscaci6n y expropiaci6n y contra toda otra forma de interferencia, independientemente de que se trate de una acci6n de caracter ejecutivo, administrative, judicial o legislative.

2. Las autoridades del Estado Anfitri6n solo podran acceder a Ia Oficina para desempenar actividades oficiales con el consentimiento del Jete/a de Ia Oficina o a petici6n de este/a, de acuerdo con las condiciones aprobadas por este/a ultimo/a.

3. Si se produjera un incendio o cualquier otra emergencia que requiera Ia adopci6n de medidas de seguridad urgentes y no fuera posible comunicarse con el/la Jete/a de Ia Oficina con suficiente antelaci6n para obtener su consentimiento respecto al acceso necesario a las instalaciones, se presupondra que el consentimiento ha sido otorgado.

4. Las instalaciones de Ia Oficina podran destinarse a reuniones , seminarios, exhibiciones y otros fines relacionados que Ia Oficina, las Naciones Unidas u otras organizaciones afines lleven a cabo.

5. Bajo ninguna circunstancia Ia Oficina se destinara a fines incompatibles con su funci6n y ambito de actuaci6n segun las disposiciones del articulo IV del presente Acuerdo.

6. Los Archivos de Ia Oficina y, en general , todos los documentos que le pertenezcan o se hallen en su posesi6n, seran inviolables donde quiera que se encuentren .

Articulo VIII Bienes, Fondos y Haberes de Ia Oficina

1. La Oficina, asi como sus bienes en cualquier parte y en poder de cualquier persona, gozaran de inmunidad contra todo procedimiento judicial a excepci6n de los casas en que las Naciones Unidas renuncien expresamente a esa inmunidad. Se entiende, sin embargo, que esa renuncia no se aplicara a ninguna medida judicial ejecutoria.

2. Sin estar limitada par controles financieros, reglamentos o moratorias de ninguna clase, Ia Oficina:

a) podra tener y utilizar fondos , divisa corriente y efectos mercantiles de cualquier clase, llevar sus cuentas en cualquier divisa y convertir a cualquier otra divisa Ia divisa corriente que tenga en custodia;

b) tendra libertad para transferir sus fondos o divisa corriente del Estado Anfitri6n a otro pais o dentro del Estado Anfitri6n ;

c) gozara de Ia tasa de cambia legalmente aplicable al realizar sus actividades financieras.

Articulo IX Seguridad y Protecci6n

El Gobierno garantizara Ia protecci6n de las instalaciones de Ia Oficina frente a posibles entradas no autorizadas de personas o grupos, danos o perturbaciones, y brindara a Ia Oficina y sus Funcionarios/as Ia seguridad y protecci6n necesarias para desempenar sus funciones , en particular cuando lo exijan circunstancias de arden publico.

Articulo X Servicios Publicos

1. El Gobierno adoptara las medidas necesarias para facilitar el establecimiento de Ia Oficina de ONU Mujeres, incluidas medidas a su disposici6n relativas a Ia provision de servicios publicos.

2. Si se produjera un evento de fuerza mayor que causara Ia interrupci6n total o parcial de los servicios mencionados, se debera conceder a Ia Oficina Ia misma prioridad que cualquier otra agencia del Sistema de las Naciones Unidas, organismos internacionales o misi6n diplomatica acreditada que se encuentre en territorio colombiano.

Articulo XI Facilidades de Comunicaciones

1. La Oficina gozara para sus comunicaciones oficiales de facilidades de comunicaci6n no menos favorables que aquellas proporcionadas par el Estado Anfitri6n a cualquier otro gobierno, inclusive las misiones diplomaticas, en lo que respecta a Ia instalaci6n, funcionamiento, prioridades y tarifas sabre correspondencia, cables, telegramas, radiogramas, telefotos, telefonos y otr~

comunicaciones, como tambien tarifas de prensa para informacion destinada a Ia prensa y radio .

2. El Gobierno garantizara Ia inviolabilidad de todas las comunicaciones oficiales de Ia Oficina, independientemente del medio utilizado; no se aplicara ninguna forma de censura a estas comunicaciones.

3. La Oficina gozara del derecho a manejar equipos de comunicaci6n , incluidas las instalaciones satelitales, a usar c6digos y despachar y a recibir su correspondencia , ya sea por mensajerfa o valija , las cuales gozaran de las mismas inmunidades y privilegios que los concedidos a mensajerfas y valijas diplomaticas. Las valijas deberan portar de forma visible el emblema de las Naciones Unidas y solo podran contener documentos u objetos de uso oficial ; Ia mensajerfa debera estar certificada como tal por las Naciones Unidas.

Articulo XII Exenci6n de lmpuestos, Derechos de Aduana y Restricciones a Ia lmportaci6n y Exportaci6n

La Oficina, asf como sus bienes, fondos y otros haberes, gozaran de las exenciones dispuestas en las Secciones 7 y 8 de Ia Convenci6n General.

Articulo XIII Participantes a las Reuniones de las Naciones Unidas

El Estado Anfitri6n respetara Ia libertad de expresi6n de todos/as los/as participantes invitados/as a las reuniones, seminaries, cursos de formaci6n , simposios, talleres y eventos similares organizados por Ia Oficina y otras organizaciones del Sistema de las Naciones Unidas.

Articulo XIV Privilegios e lnmunidades de los/as Funcionarios/as de Ia Oficina y los/as Expertos/as en Misi6n

1. El/la Jete/a de Ia Oficina, durante su estadfa en el Estado Anfitri6n , gozara de las prerrogativas e inmunidades otorgadas para los/as Jefes/as de Misi6n de misiones extranjeras acreditadas en el Estado Anfitri6n .

2. Los privilegios, inmunidades y facilidades mencionadas en el parrafo 1 anterior se aplicaran tambien a los c6nyuges y miembros dependientes de Ia familia del/a Jete/a de Ia Oficina.

3. Ademas, los/as Funcionarios/as mencionados/as:

a) Estaran inmunes contra todo proceso judicial respecto a palabras escritas o habladas y a todos los actos ejecutados en su caracter oficial ;

b) Estaran exentos de impuestos sobre los sueldos y emolumentos pagados por Ia Organizaci6n;

c) Estaran inmunes contra todo servicio de caracter nacional ;

d) Estaran inmunes tanto elias como sus c6nyuges y familiares dependientes de toda restricci6n de inmigraci6n y de registro de extranjeros;

e) Se les acordara, par lo que respecta al movimiento internacional de fondos, franquicias iguales a las que disfrutan funcionarios de categoria equivalente pertenecientes a las misiones diplomaticas acreditadas ante el Gobierno en cuesti6n ;

f) Se les dara a elias, y a sus c6nyuges y familiares dependientes, las mismas facilidades de repatriaci6n en epoca de crisis internacional de que gozan los agentes diplomaticos;

g) Tendran derecho a importar, libres de derechos, sus muebles y efectos en el momenta en el que ocupen su cargo en el pais en cuesti6n .

h) Se les permitira vender en el pais los vehiculos importados para su usa, bajo las condiciones establecidas a este respecto en los reglamentos aplicables del Estado Anfitri6n .

4. De acuerdo con Ia Carta de las Naciones Unidas, los/as Funcionarios/as de Ia Oficina gozaran de los privilegios e inmunidades que sean necesarias para el ejercicio independiente de sus funciones en relaci6n con Ia Oficina.

5. Se otorgara a los/as Expertos/as en Misi6n los privilegios, inmunidades y facilidades especificadas en los Articulos VI y VII de Ia Convenci6n General.

Articulo XV Renuncia a Ia lnmunidad

Los privilegios e inmunidades establecidas en el presente Acuerdo se conceden en beneficia de las Naciones Unidas y no para beneficia personal. El Secretario General tendra el derecho y el deber de renunciar a Ia inmunidad de cualquiera de estes individuos, en cualquier caso en que, a su juicio, Ia inmunidad impida el curse de Ia justicia y pueda renunciarse a ella sin que se perjudiquen los intereses de las Naciones Unidas.

Articulo XVI Entrada, Salida, Desplazamiento y Permanencia en el Estado Anfitri6n

1. Todas las personas mencionadas en el presente Acuerdo, incluidos los/as participantes a las reuniones, seminaries, curses de formaci6n , simposios, talleres y actividades similares organizadas par Ia Oficina, gozaran del derecho de entrar, salir y desplazarse libremente, sin ningun impedimenta, par el Estado Anfitri6n .

2. Las visas de entrada, permisos o autorizaciones, si fueran necesarios, se emitiran con Ia maxima celeridad posible.

3. Para darle mayor agilidad a Ia aplicaci6n de este articulo, ONU Mujeres notificara par escrito al Ministerio de Relaciones Exteriores, con un minima de ocho (8) dias de antelaci6n , los nombres y nacionalidades de los individuos mencionados que viajen al Estado Anfitri6n , con el fin de poder informar de los requisites a las partes interesadas en el caso de que Iuera necesario obtener una visa. ~

Articulo XVII Laissez-Passer y Certificados de las Naciones Unidas

1. El Estado Anfitri6n reconocera y aceptara como documentos validos de viaje los Laissez-Passer que las Naciones Unidas emitan para sus Funcionarios/as.

2. De acuerdo con lo dispuesto en Ia secci6n 26 de Ia Convenci6n General , las Autoridades competentes reconoceran y aceptaran los certificados que las Naciones Unidas emitan para los/as Expertos/as en Misi6n y otras personas que viajen en nombre de las Naciones Unidas.

Articulo XVIII Documentos de ldentificaci6n

1. A petici6n del/a Jete/a de Ia Oficina, el Gobierno emitira documentos de identificaci6n para todas las personas mencionadas en el presente Acuerdo, con el fin de verificar su estatus en este contexte.

2. Cuando asi lo requiera un/a funcionario/a de las Autoridades competentes, se requerira a las personas mencionadas en el parrafo anterior que presenten , pero no entreguen, sus documentos de identificaci6n.

Articulo XIX Banderas, Emblema y Distintivos

La Oficina tendra el derecho de mostrar Ia bandera, el emblema y los distintivos de las Naciones Unidas y ONU Mujeres en las instalaciones de Ia Oficina y en los vehiculos que Ia Oficina utilice para desplazamientos oficiales.

Articulo XX Seguridad Social

1. Las Naciones Unidas y el Gobierno acuerdan que, debido a que los/as funcionarios/as de las Naciones Unidas estan sujetos/as al Reglamento y Estatuto del Personal de las Naciones Unidas que, en su Articulo VI , establece un sistema integrado de seguridad social , las Naciones Unidas y sus Funcionarios/as estaran exentos de las leyes del Estado Anfitri6n en cuanto a Ia cobertura y contribuciones obligatorias a los sistemas de seguridad social durante Ia realizaci6n de sus funciones para las Naciones Unidas.

2. Las disposiciones del punta 1 supra se aplicaran mutatis mutandis a los c6nyuges y familiares dependientes de los/as Funcionarios/as de Ia Oficina, a menos que trabajen par cuenta ajena o propia en el Estado Anfitri6n o reciban ayudas de Ia seguridad social del Estado Anfitri6n. ~

Articulo XXI Cooperaci6n con las Autoridades Competentes

1. Las personas que gozan de los privilegios e inmunidades establecidas en Ia Convenci6n General y en el presente Acuerdo deberan respetar las leyes del Estado Anfitri6n , cumplir con sus obligaciones legales de caracter privado y no interferir en asuntos internes.

2. Las Naciones Unidas y ONU Mujeres colaboraran en todo momenta con las Autoridades competentes con el fin de facilitar Ia administraci6n de justicia y garantizar el cumplimiento de los reglamentos policiales y evitar el usa indebido de las facilidades , privilegios e inmunidades otorgadas a las personas mencionadas en este Acuerdo.

Articulo XXII Acuerdos Complementarios

Siempre que sea necesario, las Partes podran concluir acuerdos con el objeto de implementar o complementar el presente Acuerdo.

Articulo XXIII Soluci6n de Disputas

Todas las disputas que surjan entre las Partes sabre Ia interpretacion o aplicaci6n del presente Acuerdo se resolveran mediante negociaci6n directa entre las Partes. Si estas negociaciones resultaran infructuosas, Ia disputa se resolvera par los metodos de resoluci6n pacifica reconocidos par el Derecho lnternacional.

Articulo XXIV Disposiciones Finales

1. El presente Acuerdo tendra una vigencia de cinco (5) alios desde Ia fecha de su entrada en vigor. El presente Acuerdo podra ser renovado par acuerdo mutua de las Partes, par escrito, par periodos sucesivos de cinco (5) alios. Si una de las Partes decidiera no renovar el presente Acuerdo, este se considerara terminado.

2. El presente Acuerdo entrara en vigor en Ia fecha en que ONU Mujeres acuse recibo de Ia notificaci6n par Ia cual el Gobierno de Ia Republica de Colombia informe a ONU Mujeres de Ia ratificaci6n del Acuerdo, de conformidad con sus normas constitucionales nacionales.

3. Cualquiera de las Partes podra proponer modificaciones o enmiendas al presente Acuerdo. Toda modificaci6n o enmienda se realizara par escrito y se adoptara par acuerdo conjunto de las Partes y entrara en vigor de Ia forma establecida para Ia entrada en vigor del presente Acuerdo.

4. Cualquiera de las Partes podra terminar el presente Acuerdo mediante una notificaci6n par escrito a Ia otra Parte, en cuyo caso el Acuerdo cesara su vigencia seis meses despues de haberse recibido Ia notificaci6n. ~ ~

Agreement between The Republic of Colombia

and The United Nations, represented by the United Nations Entity for Gender

Equality and the Empowerment of Women (UN Women), on establishing the Office for UN Women in Colombia

WHEREAS the United Nations General Assembly, in Resolution 64/289 of 21 July 2010, decided to establish the United Nations Entity for Gender Equality and the Empowerment of Women (UN Women) , consolidating and transferring to that body the existing mandates, functions and resources, including the premises, infrastructure and responsibilities, of the Division for the Advancement of Women (DAW), the UN International Research and Training Institute for the Advancement of Women (INSTRAW), the Office of the Special Adviser to the Secretary-General on Gender Issues and Advancement of Women (OSAGI) and the United Nations Development Fund for Women (UNIFEM) so that it may act as secretariat and conduct operational activities at national level.

CONSEQUENTLY, UN Women and the Government, referred to jointly as "the Parties" and individually as "the Party" hereby sign this Agreement in a spirit of goodwill and cooperation and have agreed the following .

Article I Definitions

For the purposes of this Agreement,

1. "Host State" refers to the Republic of Colombia;

2. "Government" refers to the Government of the Republic of Colombia;

3. "The Parties" refers to UN Women and the Government of the Republic of Colombia;

4. "The General Convention" refers to the Convention on the Privileges and Immunities of the United Nations, adopted by the General Assembly on 13 February 1946 and with regard to which Colombia deposited its instrument of accession on 6 August 1974;

5. "The Secretary-General" refers to the Secretary-General of the United Nations;

6. "Office" refers to the Offices of the United Nations Entity for Gender Equality and the Empowerment of Women (UN Women in Colombia) ;

7. "Head of the Office" refers to the official who is Head of the Office of the United Nations Entity for Gender Equality and the Empowerment of Women (UN Women) ;

8. "Office Officials" refers to the officials assigned to serve in the Office of the United Nations Entity for Gender Equality and the Empowerment of Women (UN Women) , employed in accordance with the Staff Rules and Staff Regulations of the United Nations, excluding locally-hired staff working on hourly rates in accordance with Resolution 76{1) of the United Nations General Assembly of 7 December 1946; \\\~

9. "Experts on Mission" refers to persons, other than officials of the Office, performing missions at the request of or on behalf of the Office;

10. "Appropriate Authorities" refers to central , local and other authorities under the jurisdiction of the Host State;

11 . "Office Premises" refers to the buildings or parts of buildings and land belonging thereto, occupied permanently or temporarily by the Office, as defined in Article VI of this Agreement or in any other Supplementary Agreement, or the premises used for meetings called by the Office, together with the premises and complexes occupied , maintained or used by the Office;

12. "Office Archives" refers to all records, correspondence, documents, manuscripts, data files, still and moving pictures, image and audio recordings belonging to the Office;

13. "Office Property" refers to all property, including funds, assets or revenues belonging to the Office, held or administered by it;

14. "Telecommunications" refers to any broadcast, transmission or reception of written or verbal information, images, audio or information of any kind , by cable, radio, satellite, fibre optic or any other electronic or electromagnetic medium;

Article II Object and Scope of the Agreement

This Agreement sets out the mechanisms necessary for the efficient performance of the mandate, functions, responsibilities and resources of the Office, and governs the situation of its facilities, officials and experts on mission .

Article Ill Application of the General Convention

The General Convention shall apply to the Office, its property, funds and assets, and officials and experts on mission in accordance with the provisions of Article I of this Agreement.

Article IV Office Functions

The Office shall , among other things, perform the following functions in the Host State:

(a) Contribute to national efforts to promote and encourage gender equality and the empowerment of women by advising on policies and providing institutional support in the development of initiatives and programmes that support progress towards gender equality in all spheres.

(b) Provide technical and financial support to projects and initiatives related to its 1j

mandate. ~ ~ \

(c) Develop, in coordination with the Government, a framework for strategic cooperation and an annual programme of work with the aim of identifying areas of action with a geographical and demographic focus.

(d) Promote capacity and coordination within the United Nations System and between this and the Host State in order to contribute to gender equality and the empowerment of women .

(e) Support the application and monitoring of inter-governmental agreements.

(f) Contribute to generating knowledge on gender equality and disseminating good practice in this regard .

(g) Coordinate the actions of the United Nations System on gender equality.

(h) Contribute to strengthening the accountability of the United Nations System, mainstreaming a gender approach.

(i) Strengthen capacity building on the issue of gender among different national actors.

UN Women undertakes to keep the Government informed of the progress of its outreach activities under this Agreement.

Article V Juridical Personality

The Office shall enjoy juridical personality within the territory of the Host State and shall have the legal capacity to conduct all legal actions necessary to implement its mission goals, including:

(a) To contract; (b) Acquiring and disposing of immovable and movable property, possessing financial resources and disposing freely thereof; (c) Instituting legal proceedings.

Article VI Creation and Composition of the Office

1. The headquarters of the Office shall be established in Bogota, Colombia. The opening of Offices other than the headquarters will require prior consultation of the Host State - Ministry of Foreign Affairs, which must express its consent. The Offices shall enjoy the same conditions as set out in this Agreement.

2. UN Women shall consult with the Government in advance of any increase in the number of Officials assigned to the Office, in writing submitted to the Host State -Ministry of Foreign Affairs, following which UN Women shall take into consideration the views of the Government.

3. The Host State - Ministry of Foreign Affairs must be informed of any change of ~ location of the Office. ~ 1

Article VII Inviolability of the Office

1. The Office and Office premises shall be inviolable. The property and assets of the Office and Office premises, wherever located and by whomsoever held , shall be immune from search , requisition , confiscation, expropriation and any other form of interference, whether by executive, administrative, judicial or legislative action .

2. The authorities of the Host State may only access the Office to carry out official tasks with the consent of or at the request of the Head of the Office and in accordance with conditions approved by the latter.

3. In the event of fire or any other emergency requiring immediate safety measures, the consent of the Head of the Office will be taken as understood for any necessary access to the premises if it is not possible to contact him or her sufficiently in advance.

4. The Office premises and facilities may be used for meetings, seminars, exhibitions and other related purposes organised by the Office, the United Nations or other related organisations.

5. Under no circumstances shall the Office premises be used for purposes incompatible with their function and scope, in accordance with the provisions of Article IV of this Agreement.

6. The Office archives and , in general , all documents belonging to the Office or held by it shall be inviolable wherever located .

Article VIII Property, Funds and Assets of the Office

1. The Office and its property, wherever lodlted and by whomsoever held , shall enjoy immunity from every form of legal process except insofar as in any particular case the United Nations has expressly waived this immunity. It is, however, understood that no waiver of immunity shall extend to any measure for the execution of a legal process.

2. Without being subject to financial controls, regulations or moratoria of any kind , the Office:

(a) May hold and use funds, currency or negotiable instruments of any kind and maintain and operate accounts in any currency and convert any currency it holds into any other currency;

(b) May freely transfer its funds or currency from the Host State to another country, or within the Host State;

(c) Shall enjoy the legally-applicable financial activities.

Article IX Security and Protection

The Government shall guarantee to protect the Office facilities from intrusion, damage or disturbance, and shall provide the Office and its officials with the security and protection necessary to perform their functions, in particular, when demanded by circumstances of public order.

Article X Public Services

1. The Government shall take the necessary measures to facilitate the establishment of the Office of UN Women, including measures at its disposal with regard to the provision of public services.

2. In the event of force majeure causing the total or partial interruption of the aforementioned services, the Office shall be given the same priority as agencies of the United Nations System, international bodies and accredited diplomatic missions on Colombian territory.

Article XI Communication Facilities

1. For its official communications, the Office shall enjoy communication facilities no less favourable than those provided by the Host State to any other government, including diplomatic missions, with regard to the installation, functioning , priorities and rates for mails, cables, telegrams, radiograms, telephotos, telephone and other communications, and press rates for information used in the press and radio .

2. The Government shall guarantee the inviolability of all official communications of the Office, irrespective of the medium used, and said communication shall not be subject to any kind of censorship.

3. The Office shall enjoy the right to operate communication equipment, including satellite installations, the use of codes and to send and receive correspondence by courier or in bags, which shall enjoy the same immunities and privileges as those granted to diplomatic couriers and diplomatic bags. The bags shall bear the visible emblem of the United Nations and may only contain documents or objects for official use and the courier must be certified as such by the United Nations.

Article XII Exemption from Taxes, Duties and Export and Import Restrictions

The Office and its assets, funds and other property shall enjoy the provided for under section 7 and 8 of the General Convention .

Article XIII Participants at United Nations Meetings

The Host State shall respect the freedom of expression of all participants invited to meetings, seminars, training courses, symposia, workshops and similar events organised by the Office and other organisations of the United Nations System.

Article XIV Privileges and Immunities of Office Officials and Experts on Mission

1. The Head of the Office, during his/her stay in the Host State, shall enjoy the prerogatives and immunities accorded to Heads of Mission of foreign missions accredited in the Host State.

2. The privileges, immunities and facilities referred to in paragraph 1 above shall also be accorded to a spouse and dependent members of the family of the Head of the Office.

3. In addition, the aforementioned officials shall :

(a) Be immune from legal process in respect of words spoken or written and all acts performed by them in their official capacity;

(b) Be exempt from taxation on the salaries and emoluments paid to them by the United Nations;

(c) Be immune from national service obligations;

(d) Be immune, together with their spouses and relatives dependent on them, from immigration restrictions and alien registration ;

(e) Be accorded the same privileges in respect of exchange facilities as are accorded to the officials of comparable ranks forming part of diplomatic missions to the government concerned ;

(f) Be given, together with their spouses and relatives dependent on them, the same repatriation facilities in time of international crisis as diplomatic envoys;

(g) Have the right to import free of duty their furniture and effects at the time of first taking up their post in the country in question;

(h) Be allowed to sell in the country the vehicles imported for their use under the conditions stipulated in the applicable regulations in the Host State in this regard .

4. In accordance with the Charter of the United Nations, Officials of the Office enjoy such privileges and immunities as are necessary for the independent exercise of their functions in connection with the Office.

5. Experts on mission shall be granted the privileges, immun~ies and faciliti~( ~ specified in Articles VI and VII of the General Convention. \ '\?\I

Article XV Waiver of Immunity

The privileges and immunities set out in this Agreement are granted in the interests of the United Nations and not for personal benefit. The Secretary-General shall have the right and the duty to waive the immunity of these individuals in any case where, in his opinion , the immunity would impede the course of justice, and it can be waived without prejudice to the interests of the United Nations.

Article XVI Entrance, Exit, Movements and Stay in the Host State

1. All persons referred to in this Agreement, including all participants in the meetings, seminars, training courses, symposia, workshops and similar activities organised by the Office, shall have the right to enter, leave and freely move without impediment within the Host State.

2. Entry visas, permits or authorisations, when necessary, shall be issued as speedily as possible.

3. To speed up application of this article, UN Women will notify the Ministry of Foreign Affairs in writing of the names and nationality of the aforementioned people who will travel to the Host State a minimum of eight (8) days in advance in order to be able to notify the interested parties of the requirements in the event that a visa is required .

Article XVII United Nations Laissez-Passer and Certificates

1. The Host State shall recognise and accept laissez-passer issued by the United Nations to its officials as valid travel documents.

2. In accordance with the provisions of Section 26 of the General Convention, the appropriate authorities shall recognise and accept certificates issued by the United Nations to experts on mission and other persons travelling on the United Nations' behalf.

Article XVIII Identification Documents

1. At the request of the Head of Office, the Government shall issue identification documents to all persons mentioned in this Agreement, for the purpose of verifying their status within this context.

2. When so required by an official of the appropriate authorities, the persons mentioned in the preceding paragraph shall be required to present, but not to surrender, their identification documents. \\~~

Article XIX Flags, Emblem and Distinctive Symbols

The Office shall have the right to display the flag , emblem and distinctive symbols of the United Nations and UN Women at the Office premises and on the vehicles used by the Office for official business.

Article XX Social Security

1. The United Nations and the Government agree that, due to the fact that officials of the United Nations are subject to the United Nations Staff Regulations and Rules, including Article VI thereof, which establishes an integrated social security system, the United Nations and its officials shall be exempt from the Host State's laws regarding compulsory cover and compulsory contributions to social security systems during their assignment with the United Nations.

2. The provisions of paragraph 1 above shall apply mutatis mutandis to the spouses and dependent family members of Office Officials, unless they are employed or working on a self-employed basis in the Host State or are receiving social security provisions from the Host State.

Article XXI Cooperation with the Appropriate Authorities

1. Persons enjoying the privileges and immunities established in the General Convention and in this Agreement are required to respect the laws of the Host State, comply with their legal obligations of a private nature and not to interfere in internal affairs.

2. The United Nations and UN Women shall cooperate at all times with the appropriate authorities in order to facilitate the administration of justice, ensure the observance of police regulations and prevent the abuse of the facilities , privileges and immunities granted to the persons mentioned in this Agreement.

Article XXII Supplementary Agreements

Whenever necessary, the Parties may conclude agreements for the purpose of implementing or supplementing this Agreement.

Article XXIII Resolution of Disputes

Any dispute that may arise between the Parties regarding the interpretation or application of this Agreement shall be resolved through direct negotiation between the Parties. In the event of these negotiations being unsuccessful, the dispute shall

Article XXIV Final Provisions

1. The term of this Agreement is five (5) years from the date of its entry into force. The Agreement may be renewed upon the mutual agreement of the Parties, in writing , for subsequent periods of five (5) years. Should one Party decide not to renew the Agreement, it will be considered terminated.

2. This Agreement shall enter into force on the date that UN Women acknowledges receipt of the notice by which the Government of the Republic of Colombia informs UN Women of ratification of the Agreement in accordance with its national constitutional rules .

3. Either of the Parties may propose changes or amendments to this Agreement. Any change or amendment shall be made in writing and adopted by joint agreement of the Parties and shall enter into force in the manner established for the entry into force of this Agreement.

4. This Agreement may be terminated by either of the Parties by notification in writing to the other Party, in which case it will cease to be valid six months following receipt of said notification.
