AURORA – Gerardo Parra, owner of La Chicanita Bakery in Aurora and former Mayor of Pantepec, Puebla, invited a group of Hispanic leaders and representatives from Aurora government to learn about how Mexican citizens in Aurora can work with SEDESOL in the 3 x 1 program.

Jorge Gutierrez Ramos, a Federal Delegate with the Social Development Ministry (SEDESOL) in Mexico, explained the benefits of this program to those who attended the luncheon presentation, which took place on March 20 at La Quinta de los Reyes. He also highlighted the work Parra did as Mayor of Pantepec and the infrastructure works that were done in his municipality.

The 3 x 1 program for migrants is a federal government effort that helps migrants in the United States to work to bring services to their communities of origin, providing the support of the municipal and state government.

“With the contributions of migrant clubs overseas, each peso that the club provides for a project is matched by the three government entities (federal, state and municipal),” Gutierrez said.

The projects that can be funded through this program include drinking water, sewer systems and electricity; street paving and construction; education, sports and health infrastructure; roads and highways and other projects that benefit the community.

Among those attending the meeting were State Rep. Linda Chapa LaVia, Aurora Councilwoman Juany Garza, Kane County Board Representative Monica Silva and local businessmen Jesus Sanchez, Adan Sanchez and Juventino Cano.

The meeting ended with the joyful music of mariachi.

MARCH 25, 2011

How do I find out the status of my petition if I don’t have copies of the documents?

By DAVID RICHMOND

This week I will answer the question that one of our readers sent to my office.

“Many years ago my U.S. citizen brother filed immigration paperwork on my behalf so I can receive immigration benefits in the U.S. A long time has passed and I don’t know what ever happened with that paperwork.”In many circumstances family members, meaning brothers

and sisters of U.S. citizens, can be the beneficiary of a properly filed immigrant visa petition. When a U.S. citizen petitions for a brother or sister to receive immigration benefits, it is always a two-step process.

The United States Citizenship and Immigration Services (USCIS) approves the petition, then you have to wait for visa availability.

Under the current United States Immigration laws a maximum of 226,000 people can legally receive visas to come to the United States as permanent residents.

With a limited number of visas available, and a high demand for visas, it can take many years for a brother or sister to receive a visa. Currently there are visas available for people who filed petitions for brothers and sisters on Jan. 1, 2000 or before. But seeing how some countries, like Mexico, there are so many people that want to enter the United States, they are currently working on visa availability for people who filed for brothers or sisters on Jan. 22, 1996.

Therefore, if your brother or sister petitioned for you before Jan. 22, 1996 and your home country is Mexico, you can receive a visa to enter the United States.

We know many people are in the United States undocumented who are the beneficiaries of petitions filed many years ago. In that circumstance there is a provision in the law, called 245(i) where if you have been in the United States before December 30, 2000 and the petition was filed before April 30, 2001, you can pay a fine of $1,000 and adjust your status while still in the United States. Therefore, you do not have to leave the United States when a visa becomes available.

One of the benefits that a brother or sister receives is when a visa becomes available their spouse also can take advantage of the visa. This is called a derivative beneficiary. Also, all of your brother’s children who are unmarried and under the age of 21 also can receive a visa to enter the United States.

If your nephews or nieces are over the age of 21 or get married they cannot receive derivative beneficiary.

When I say they have the ability to receive a visa, with that visa when they enter the United States they are permanent residents of the United States and receive a green card.

In many circumstances, the petitioner who filed the original paperwork, who is the original petitioner, would have moved or lost the paperwork. And the question becomes what can I do?

In those circumstance I can write the Immigration Service a letter on your behalf requesting a copy of the file and then the Immigration Service will send me a copy of the paperwork showing the priority dates of your case, when your case was

filed, and we can track down the information to find out specifically what happened to it. In many circumstances what we end up finding out is the proper case numbers and proper priority dates or the correct priority dates, and therefore we can or you can sometimes act upon that information if it is current, or at least you know or have a very good idea of how much longer is going to be.

Because what you don’t want to happen is a visa becomes available, the National Visa Center tries to contact you, you are not contacted because you have moved or there is a problem, they don’t have your correct address, and then, after one year, you lose the availability of that benefit and they will deny your case in many instances based on that. Therefore it’s important you know when your priority date is, when to expect information from the National Visa Center and to keep the National Visa Center advised of your most current address.

These are just some of the services that the Latino Immigration and Legal Center provides. You can submit your questions and attorney David Richmond may answer them in this space. Send your questions to: [email protected]

Undocumented are trembling with the new E-Verify Self Check

WASHINGTON – The U.S. government has launched a new version of the E-Verify program that allows people in the United States to check their own employment eligibility status.

This has caused fear among the indocumented immigrants because now it will be harder for them to find work, as their information will be checked against government databases.

The E-Verify Self check system is administered by the Department of Homeland Security and the Social Security Administration.

Currently residents in Arizona, Idaho, Colorado, Mississippi, Virginia and the District of Columbia have access to this system, which will continue to expand until it is available nationwide.

The E-Verify program compares information from the Employment Eligibility Verification Form (I-9) against federal government databases to verify workers’ employment eligibility.

The E-Verify Self Check system allows each user to identify information inaccuracies, which can go from typographical errors to unreported name changes, which would result in a mismatch when they look for a job.

If users find mistakes, they can send corrections to SSA and DHS before applying for employment.

The way the system works is as follows: 1) The user inputs his or her information

on an Internet Web site (name, date of birth, address.) www.uscis.gov/everify

2) The user confirms his or her identity by answering some demographical or financial questions.

3) The user provides information about his eligibility to work, including a Social Security number and, according to their immigration status, their Alien Registration number.

4) The system compares the information provided with SSA and DHS databases, giving the user a report about his or her status and if he or she is eligible to work in the United States.

The results from an E-Verify Self Check query are not shared with employers or prospective employers. The results from an E-Verify Self Check query do not replace an employer’s E-Verify request.

If the Self Check system cannot confirm eligibility to work, individuals are provided with instructions on how to resolve a potential data mismatch in their SSA or DHS records. These instructions are available in English and Spanish.

There are some cases in which Self Check is not able to generate an identity assurance quiz.

These cases include entering information incorrectly, which prevents the independent identity assurance service from locating any information about that person; when a user has recently attempted to take the identity assurance quiz too many times; when a user lacks sufficient financial records because he or she recently moved to the united States or just started working; when a user has placed a security freeze on his or her credit report.

Those who have authorization to work in the United States but are unable to generate an identity assurance quiz using the Self Check system or those who receive errors who prevent them from successfully completing the identity assurance quiz can contact the USCIS National Customer Service Center at 800-375-5283 for help.

LOS ANGELES – A man who spent 20 years in prison for a drive-by killing was set free March 16, after most of the witnesses changed their testimony.

Francisco “Franky” Carrillo, 37, was 16 when he was sent to Folsom prison to serve to life sentences for a murder.

Carrillo was charged in the murder of Donald Sarpy, 41, which took place Jan. 18, 1991. Sarpy was killed when he was leaving his home in Lynwood.

Sarpy’s son, Dameon, and five other friends who were nearby were not injured.

Early in the investigation the witnesses gave authorities conflicting and vague details about what had happened.

Some said they had hears a Hispanic male yell a gang slogan while driving by the area and only described the gunman as a Hispanic man.

The witnesses also didn’t agree on the car’s description.

Carrillo, who was 16 years old at the time, became a suspect after a mix up with some street names took police to his home and he was identified as the gunman in another incident.

The first to identify Carrillo as the shooter in Sarpy’s death was Scott Turner, one of the attempted murder victims. He identified

Carrillo in a photo lineup and told his friends he had chosen suspect number 1.

Because there was no physical evidence linking Carrillo to the crime scene, the witnesses’ testimony was very important.

The first trial ended with a hung jury and the second trial a jury found Carrillo guilty.

He always denied being involved in the crime, saying he was at home watching TV when the murder took place.

Supreme Court Judge Paul A. Bacigalupo overturned the conviction March14, after a recreation of the crime scene raised doubts about the witnesses’ accounts. Also five of the six witnesses, including Sarpy’s son, retracted their statements identifying Carrillo as the gunman.

The judge didn’t rule whether Carrillo is guilty or innocent, but said a change in the evidence raised doubts on the verdict. The prosecutor’s office still has 60 days to determine if they will try Carrillo again for the murder, but said it would be unlikely.

During six days of testimony the witnesses admitted they couldn’t see the face of the gunman.

David Lynn, a defense investigator, testified he had a confession from another man stating Carrillo’s innocence.

Carrillo was defended during his appeal by the Innocence Project of Northern California.

Francisco Carrillo was set free after he spent 20 years in jail sentenced for a crime he did not commit.

two singers attacked in separate incidents

UNA VOZ STAFF

MEXICO – Two Mexican singers were attacked in two separate incidents in western Mexico.

Gerardo Ortiz and Jose Angel Ledesma “El Coyote” were not injured in the attacks.

Gerardo Ortiz, a Mexican Regional music singer, was attacked after his show in Villa de Alvarez, Colima on March 20.

According to information provided by the Colima State Attorney General, the singer was attacked by a group of gunmen while he was on his way to his hotel. He was aboard a Suburban truck with his father, a female companion, his manager Abel Valle and his driver Ramiro Cano.

The vehicle was attacked with AK-47 rifles. In the incident the driver and the manager were killed and the female companion was injured.

Ortiz and his father were uninjured. In the beginning it was reported that both men had been kidnapped, but the singer later on issued a press release stating that he had sought refuge and was not hurt.

Meanwhile, Jose Angel Ledesma “El Coyote”, a member of Banda Tierra Santa, was attacked with an explosive device while performing on March 20 in Bahia de Banderas, Nayarit, during the San Jose del Valle festival.

In this case, someone from the crowd threw an explosive device, apparently homemade, to the stage. Three of the band members were injured, but they have been released from the hospital and are now on the mend.

Based on this attack “El Coyote” made the decision of leaving Mexico with his family. He also said he didn’t know why he and his band were targeted.
