EXECUTIVE SUMMARY

Project Description

MTA Capital Construction is managing construction of the Fulton Center in Lower Manhattan. The project willimprove access and connectivity amongst severalsubway lines (A,C,E,J,Z,R,2,3,4,5), create modern retail spaces, provide improved passenger amenities and upgrade the complex to full ADA compliance. The project includes the building of a new transit hub for Lower Manhattan (the Transit Center Building) and the restoration of the historic Corbin Building. Note: As of June 2010, MTA New York City Transit service changes include the W train elimination and the M trainwhich no longer serves Fulton Street.

Budget Summary (As of 09/30/2012)

PSR does not separate expenditure in Federal and Local funding. Highlights

The J/Z to A/C southbound transfer was open to the public on August 2, 2012.

On September 12, 2012 Contract 4B Fulton Deck from Column Line T-0 to T-4 was completed and turned over to the 4F contractor allowing for placement of the crane and the start of the mullion installation on Fulton Street.

Dey Street Headhouse opened to the public on October 8, 2012.

Began the Request for Proposal (RFP) process for Master Lessee on August 2, 2012.

On September 12, 2012, Recovery Plan #9 was approved by the FTA for schedule and budget changes.

Contract Progress Status by ExpenditureAs of September 30, 2012, all Fulton Center (FC) contracts have been awarded. Five contracts achieved substantial completion and are closed out (1, 3, 4I, 2 and 4A). The FC is 78%complete. The percent complete is based on the projects total expenditures of $1.09 billion to date, an increase of $45.4 million from the last quarter with an Estimate At Completion (EAC) of $1.4 billion.

Active ContractsAll contract dates are from the contractor’s accepted schedule updates as of September 2012.

A/C Mezzanine Reconstruction and J/Z Vertical Circulation (Contract A36121, 4B) Based on the current working/progress schedule, the contract is currently 119 work days behind schedule (update no. 34). Delays are due to communication changes, changes to the fire alarm system and the delivery and installation of the elevators. These delays are currently not expected to affect the approved plan substantial completion date of March 3, 2013.

The installation of NS-25 and NS-26 stairs were completed and the J/Z to A/C southbound transfer was opened to the public on August 2, 2012 in accordance with the contract intermediate phasing milestone.

The sewer box construction along Fulton Street was completed in September 2012.

New York City Transit (NYCT) completed the installation of the new booth N-98 at the lower level of 135 William Street. The booth was open to the public on September 17, 2012, allowing the closure and removal of booth R113A, opening the area for the contractor to complete their work at the South Street Seaport Stair.

It was discovered that a section of subway track needed to be secured along the J/Z line at the NB platform. The vertical and horizontal movement of the track under load would compromise the compatibility of the Americans with Disabilities Act (ADA) requirements along the J/Z platform. Therefore, the platform work will be performed after the completion of the required

track work. The NB track work began during the October 13, 2012 weekend General Order (GO). During this GO, the contractor discovered additional work needed on the tracks. The contractor has requested a revised Additional Work Order (AWO). Scheduling and negotiations with the contractor to repair the track are currently on-going.

Three 55 hour weekend GOs for the month of October have been scheduled to perform the additional work on the track and the ADA platform.

The architectural finishes at the new entrance at 150 William are well underway.

All structural work at 129 Fulton Street is complete. The concrete placement to close the tunnel roof was completed on August 22, 2012. The curb and sidewalk were restored on September 22, 2012. The lobby finishes are scheduled to be completed by early November. The elevator is expected to be ready for testing in early November 2012.

4/5 Station Rehabilitation and Dey Street Headhouse (Contract A36137, 4C/D) Based on the current working/progress schedule (update no. 32), this contract is currently 194 work days behind schedule. This delay is due to the new enhancement work as well as changes to the communications systems. Both the MTACC and the contractor expect to reduce this delay by expediting construction in the available areas and re-sequencing work activities.

In the Dey Street Headhouse metal ceiling installation, egress doors, fare array partition installation have been completed. The Glass Fiber Reinforced Ceiling (GFRC), metal panel ceiling, floor tile, fire damper, glass partitions, lighting, public address and sprinkler installation is ongoing on the concourse level. The Dey Street entrance and PE-4 was completed and opened to the public on October 8, 2012. Chemical injection grout work continues as needed throughout the station.

Progress continues for the tile work on the 4/5 Line platform level; cleaning of the existing tiles, installation of the mosaic tile bands, glass wall tiles, pink marble wall panels and terracotta work along the northbound and southbound sides. The glass enclosure for PE-5 is complete as well as the balustrades around NE-8 escalator and stairs NS-13. PE-5 is expected to be complete by late November 2012.

Dey Street and R Underpass Finishes (Contract A36138, 4E) Based on the current working/progress schedule, this contract is currently 394 work days behind schedule (update no. 27). This delay is due to the new enhancement work, the communication changes and delays to the elevator and the ceiling panel delivery/installation. As a result of delays, a new substantial completion date is currently being calculated.

Installation of the metal wall panel, the glass wall panels and GFRC is 95% complete. The metal ceiling at the R Underpass is expected to be completed in October 2012. Elevator testing is in progress. In the concourse, ductwork, sprinklers, customer information system, doors, closed circuit television (CCTV), access control and help point intercom installation is in progress.

The new enhancement display panel mock-up was approved on September 7, 2012. The first of the 6 display panels will arrive on site by mid October 2012. The remaining panels are expected on site by the end of October and expected to be installed by mid November 2012.

Transit Center Building (Contract A36125, 4F) This contract is on schedule (update no. 17).

Plaza Schiavone Joint Venture (PSJV) continued on the concourse and mezzanine levels with fire protection, MEP, masonry and hollow metal frames installation. New stone flooring continued under the 4/5 underpass and the concourse level. PSJV installed escalators numbers53, 63, 60 and 61. The electricians are currently installing the escalator control conduits. On the platform and street levels, ductwork installation continued along with fire protection, MEP, masonry walls, communications, and hollow metal frames installation. On level 2, masonry installation continued along with communications, MEP, hollow metal frames and fire protection installation.

The concrete slab on level 3 was completed. On level 4, concrete pads were placed and MEP installation continued. On level 5, the electrical conduit installation continued along with MEP, masonry walls, hollow metal frames, telephone, security system, public address and CCTV installation. On level 7, the sloped concrete roof fill was placed. On level 8, masonry walls and hollow metal frames continued along with MEP and fire protection installation. On level 9, masonry walls continued along with MEP installation.

The installation of the pavilion cladding mullions on Fulton Street began in September 2012. The Pavilion cladding on Broadway is 90% complete. PSJV continued work on the service elevators SE-50/51 hoist way; the service elevator machine controllers have been installed. Installation of the service elevator rails and brackets is complete and work within the elevator machine room is ongoing. PSJV is also nearly complete with the installation of the dome cladding; PSJV is preparing for the start of the interstitial building cladding in the first quarter of 2013. The fabrication of the anchors and channels for the donut glazing is in progress and deliveries are expected in late 2012. The chiller piping is near completion and PSJV is preparing for testing. Testing of MEP work for completed segments has commenced.

The structural steel modifications due to new enhancements have begun for the 3rd floor. The pavilion glass (GL-1) (Insulated Glass Units) IGUs have been installed in the pavilion façade. Granite tile is being installed in the 4/5 underpass (4C/D). Escalators E-53 and E-62 have been delivered to the site and are being installed. HVAC ductwork, plumbing piping, sprinkler piping, electrical and communications conduits continue to be installed on all levels. The piping for the chillers and cooling towers is being prepared for hydrostatic testing.

Corbin Building Restoration (Contract A36126, 4G) This contract is currently 14 work days behind schedule (Draft of update no. 26). This delay is due to the brownstone installation. Both the contractor and MTACC are working together to mitigate this delay.

Installation of mechanical, plumbing and electrical systems are ongoing at all levels. Interior finishes work such as drywall installation, plastering and painting prep continued throughout the building. Restoration work is in progress on the existing staircase. At the street level, escalator installation continues, along with strengthening of the existing columns. Wood window work is in progress at the sixth, seventh and eighth floors. On the exterior of the building, the subcontractor continued rebuilding the south parapet, installation of terra cotta, cast iron and masonry repointing and is mostly complete. At the roof level, installation of the terra cotta color roof shingles continued on the east tower, stucco was installed on the exposed brick walls, and installation of the modified bitumen roof system continued.

During this reporting period, Keim Coating was completed. In addition, MTACC has issued several directives to progress the work on copper panels in the escalator lobby, the tile finish in the lobby and the fire dampers in the mechanical rooms. Removal of the scaffolding on the south façade began on October 11, 2012.

A retroactive Notice to Proceed (NTP) will be issued to the contractor to mitigate a negative impact on the schedule, to restore and rehabilitate the lobby to its 1917 style.

The inspection of the south façade by the 3rd party consultant was completed. A report was provided to the construction manager’s office and all punch list work was completed by October 10, 2012.

R Cortlandt Street Southbound Platform Rehabilitation (A36165)Contract substantial completion was achieved on August 29, 2011 and opened for revenue service on September 6, 2011. The close out date for this contract was forecasted for February 2012 and is now being revised.

Master Lease StatusAs FC moves towards completion, MTA is soliciting proposals for a Master Lessee (ML) who will lease, maintain and operate the facility. The ML will lease out the 65,000 square feet of space in the Fulton Building, the Corbin Building and the Dey Street Headhouse. In addition, the ML will lease and program the 50 large scale digital signs throughout the Fulton Center. Through a lease back arrangement the ML will maintain and operate the facility

On August 2, 2012, the MTA issued a RFP and is now midway thru that process. MTA has received over 500 web hits and 80 attendees at the pre-proposal meeting which was held on September 21, 2012. The ML qualifications are due on November 2, 2012 and Proposals are due on November 30, 2012. MTA expects to negotiate during the 1st Quarter 2013 and target getting the ML on board by 2nd Quarter of 2013. This will allow the ML about a year to get tenants on board and fit out spaces, coinciding with the June 2014 opening.

Construction Management Status MTACC continues to meet monthly and to provide project status presentations to the New

York City Department of Transportation (NYCDOT) regarding the program wide Maintenance and Protection of Traffic (MPT) requirements for all construction contracts related to the FC project; any changes in the MPT or permits are discussed during these meetings. Meetings were held on July 25, 2012, August 29, 2012 and September 26, 2012.Due to the extent of the work on John Street, which in addition to the FC work includes 180 Broadway, 24 John Street and Nassau Street. NYCDOT has continued to hold bi-weekly coordination meetings on Tuesday afternoons. The work and the meetings have continued through the end of the third quarter of 2012 and will continue at the discretion of the NYCDOT.

A Quarterly Risk Workshop was held on September 25, 2012. The 4B and 4F interface issues are being worked out at the site and an updated risk assessment for Contract 4B and 4F were performed in February by Golder Associates. A final report from Golder was received in June (for additional information regarding the report please see page 52 “Risk Management”).

A Quality Workshop was held on August 30, 2012 with Quality Engineers from all the contracts. MTACC requested that the contractors review their procedures for preparing as-built drawings, O&M Manuals and other record documents. The contractor for Contract 4E has submitted their procedure and it is being reviewed by MTACC Quality.

The Safety Roundtable Workshops were held on July 27, 2012, August 31, 2012 and September 28, 2012 with Safety Engineers from all contracts were in attendance. The major theme for the July 27, 2012 and August 31, 2012 roundtables were the hazards associated with scheduling pushes (Dey Street Headhouse, Concourse, Corbin Scaffold removal and façade work) as well as additional visitors (RFP tours and NYCT commissioning groups) to the contracts. The meeting that was held on September 28, 2012 discussed the rise in incident rates from the second to third quarter and it was asked of the contractors who have had an increase to come up with a plan going forward to lower the injuries.

The Utility Management Plan (UMP) was accepted by the FTA on September 20, 2012.

MTACC continues to meet with NYC Department of Design and Construction (DDC) regarding the water main work on Broadway. DDC plans to award the contract in January 2013, following mobilization the construction will begin in March 2013. The work is expected to start at Ann Street, but not expected to start south of Fulton until December 2013 and finish in August 2014. The last meeting was held on August 13, 2012. On October 9, 2012, MTACC was informed that DDC was given approval to advertise the contract.

Buy America and Cargo Preference Contractors prepared and submitted Buy America and Cargo Preference Matrices to MTACC

to track items that must be shipped on U.S. vessels. The matrix is an ongoing report and will be updated by MTACC as needed. Below is our calculation to track cargo preference tonnage as of August 2012.

1. Total (approximate) tonnage for the project 2078 Tons2. Total (approximate) tonnage to meet FTA cargo preference (50%) 1039 Tons3. Total tonnage as of August that is not on an American carrier 565 Tons4. Total tonnage as of August that is shipped on an American carrier 717 Tons5. Based on the above we can fairly predict that when the project is completed we will have exceeded our cargo preference requirement by approximately 474 tons. MTACC anticipates meeting FTA’s cargo preference of 50% within the 4th Quarter 2012.

The longest path currently starts with the completion of the CCTV system, followed by pre-testing and witness testing of the CCTV system, inspections of escalator NE-8, final testing of NE-8 and substantial completion.

from the last quarter, which includes $5.5M for the construction payment and $1.1M for the supporting cost payment.

The total approved AWO of $3.7M, which is an increase of $0.4Mfrom the last quarter.

completion date The longest path starts with the fabrication and delivery of card

readers, which includes provision of additional card readers (AWO #15), followed by installation, testing of the security system, training and as-built submission. This longest path is expected to shift back to include the CCTV related activities when the NTP for AWO #15 has been provided.

Budget: A total expenditure of $20.1M indicates an increase of $2.6M

from the last quarter, which includes $2.2M for the construction payment and $400K for the supporting cost payment.

The total approved AWOs are $1.9M, which is an increase of $200K from the last quarter.

The longest path currently starts with the negotiation of MOD54 associated AWO #90, followed by procurement and installation of the ornamental metals and support steel, installation of the CMU and stone flooring on the lower levels, GFRC and metal wall panels on the platform, followed by installation of the metal wall panels on the street, street level inspections and issuance of punch-list

The second longest path is through the donut glazing; when the materials are delivered to the site, the in place mock up for the donut cladding will be erected for approval. Subsequent to the approval of the mock up, PSJV can begin installing the anchors, mullions and glass for the inner and outer portions of the donut. The cable net and reflector panels will be installed after the inner donut. This path concludes with inspections and punch-list on the second and third levels.

Budget:

A total expenditure of $90.6M indicates an increase of $12.4M from the last quarter, which includes $11.8M for the construction payment and $600K for the supporting cost payment.

A total of $4.4M in AWOs has been approved for this quarter.

The longest path begins with the negotiation of AWO #70 Brownstone Buy America issues, followed by submission and approval of the shop drawings, procurement of brownstone, installation of stone at the West and the South towers, scaffold removal, installation of framing and metal panels for canopy, completion of the inspections and issuance of punch list.

Budget:

A total expenditure of $54.2M indicates an increase of $4.8M from the last quarter, which includes $9.5M for the construction payment and $380K for the supporting cost

The total approved AWOs is $5.5M. Transfer $1M from TA Labor and $0.5M from EFA CM to

The façade work will continue and will include completion of the installation of the brick on the north façade; the cast iron elements on Broadway and John Street; the installation of new terra cotta pieces on Broadway, John Street and the north façade; and the application of the Keim coating on the existing terra cotta. The brownstone work started in September.

The interior fit-out work will proceed and will include substantial completion of the MEP work and related testing, sheet rock work, spackling, priming and painting.

The roofing work will proceed and will include the completion of the towers and the flat roof.

The lobby design in Contract A36126, 4G – will be completed and the RFP issued to the contractor.

Mechanical piping (chilled water, hot water and glycol system) are in the process of being tested and should be complete by the end of October 2012.

As-built drawing submittals are on-going for electrical, mechanical and plumbing systems.

Continue O&M Manual submissions, with 25% received to date.

The fire alarm system installation is on-going, all back boxes for the various devices (smoke detectors, horn strobes and heat detectors) have been installed from the second floor through the eight floor. The contractor is currently pulling wires.

For the communications system, all conduits will be installed.

Construction Phase Support Services Lead the Bi-Weekly Progress Meetings for Contracts 4B, 4C/D, 4E, 4F and 4G.
