Promotion of safety and health at workrequires the co-operation of proprietors andpersons employed. The Factories and IndustrialUndertakings (Amendment) Ordinance 1989imposes General Duties on proprietors andpersons employed with regard to safety andhealth at work. This guide is prepared to assistpersons employed in understanding the GeneralDuties Provisions.

The General Duties Provisions arecomprehensive provisions with wide applications.Contrary to other existing safety and healthlegislation which stipulates safety and healthrequirements in technical details, the GeneralDuties Provisions only express the duties ofproprietors and persons employed in generalterms with regard to securing the safety andhealth of themselves and of others at work.

Persons employed in industrial undertakingshave duties to ----

(a) take reasonable and cautious measures tosecure the safety and health of themselves andof others who may be affected by their acts oromissions at work. They must not do things thatendanger the safety and health of themselvesor of others, and should take proactive steps tofind out the hazards at work and comply with therelevant codes of practice on safety.

(b) co-operate with their proprietors or any otherpersons so far as is necessary to enable them tocomply with or to perform their legal duties andresponsibilities for securing the safety and healthat work of all the persons employed.

(a) A person employed who breaches the GeneralDuties Provisions commits an offence, and isliable to a fine of $25,000 upon conviction.

(b) A person employed who wilfully and withoutreasonable excuse does something thatendangers himself/herself or other personscommits an offence, and is liable to a fine of$50,000 and to imprisonment for 6 months uponconviction.
