Derecho al olvido en Internet: Google y la doctrina europea

Resumen
Este ensayo desarrolla parte de la problemtica moral, social y legal que hay detrs de la
justificacin y la implementacin del llamado derecho al olvido en Internet, segn el
cual, dadas ciertas circunstancias, los individuos pueden solicitar a un motor de
bsqueda la eliminacin de algunos enlaces asociados a sus nombres. Se reflexiona
sobre el particular a partir de una sentencia emitida por el Tribunal de Justicia de la
Unin Europea en mayo de 2014, as como de las recomendaciones del Grupo de
Trabajo del artculo 29 sobre proteccin de datos, la prctica de Google y el informe de
su Consejo Asesor.

Abstract
This essay gives an account of some moral, social and legal problems facing the
attempts for justifying and implementing the so-called right to be forgotten in Internet.
This right means that under certain conditions individuals are entitled to ask search
engines to remove links with personal information about them. Our inquiry takes into
account a ruling from the Court of Justice of the European Union made public on May
13th 2014, as well as the recommendations given by Article 29 Data Protection Working
Party, the actual practice of Google and the report of its Advisory Council.
