ENRILE VS SALAZAR

n February 1990, Sen Enrile was arrested. He was charged together with Mr. & Mrs. Panlilio, and Honasan for

the crie of rebellion with urder and ulti!le frustrated urder which allegedly occurred during their failed

cou! atte!t. Enrile was then brought to "a! #aringal. Enrile later filed for the habeas cor!us alleging that

the crie being charged against hi is none$istent. %hat he was charged with a criinal offense in an

inforation for which no co!laint was initially filed or !reliinary inestigation was conducted, hence was

denied due !rocess' denied his right to bail' and arrested and detained on the strength of a warrant issued

without the (udge who issued it first haing !ersonally deterined the e$istence of !robable cause.

ISSUE: )hether or not the court should affir the Hernande* ruling.

HELD: Enrile filed for habeas cor!us because he was denied bail although ordinarily a charge of rebellion

would entitle one for bail. %he crie of rebellion charged against hi howeer is co!le$ed with urder and

ulti!le frustrated urders + the intention of the !rosecution was to ae rebellion in its ost serious for

so as to ae the !enalty thereof in the a$iu. %he S" ruled that there is no such crie as -ebellion with

urder and ulti!le frustrated urder. )hat Enrile et al can be charged of would be Si!le -ebellion

because other cries such as urder or all those that ay be necessary to the coission of rebellion is

absorbed hence he should be entitiled for bail. %he S" howeer noted that a !etition for habeas cor!us was

not the !ro!er reedy so as to aail of bail. %he !ro!er ste! that should hae been taen was for Enrile to file

a !etition to be aditted for bail. He should hae e$hausted all other efforts before !etitioning for habeascor!us. %he Hernande* ruling is still alid. ll other cries coitted in carrying out rebellion are deeed

absorbed. %he S" noted, howeer, that there ay be a need to odify the rebellion law. "onsidering that the
