L os distintos temas en los que participó la ANIQ durante 2016, demandaron una activa participación de la

Comisión Ejecutiva, de su Consejo Directivo,

así como de cada una de las comisiones y

secciones que conforman la Asociación.

Hoy, la industria enfrenta un creciente

problema de escases en muchos de los

productos que nos provee Pemex, situación

que ha generado un importante desabasto para

nuestra industria, y subsecuentemente para

las industrias a las que nuestro sector provee

(automotriz, cuidado personal, alimentos,

entre otras).

Por lo anterior, una de las actividades que

más recursos demandó de la Asociación fue

la relativa a lograr la autosuficiencia en el

suministro de materias primas y energéticos

para la industria, condición indispensable para

alcanzar nuestra anhelada competitividad.

Para alcanzar dicha competitividad,

trabajamos con las distintas autoridades

para lograr que en el corto y mediano plazos

contemos con un Pemex fuerte, que es y

seguirá siendo eslabón fundamental no solo

para el desarrollo de nuestra industria, sino

para el desarrollo de México.

T he various issues ANIQ was engaged in during 2016 required an active participation by the Executive Committee and

the Board of Directors, as well as each of the

commissions and sections that make up the

Association.

Today, the industry faces a growing problem

of shortages in many of the products provided

for us by Pemex. This situation has created a

sizeable lack of provisions for our industry

and, in turn, for the industries supplied by the

Chemical Industry (automotive, personal care,

foods, among others).

Consequently, one of the areas that

demanded the most resources from the

Association was that of achieving self-

sufficiency in the supply of raw materials and

energy products for the industry, a prerequisite

for reaching our desired competitiveness.

To reach that competitiveness, we are

working with various authorities to ensure that

in the short and medium terms we will have a

strong Pemex that is, and will continue to be, a

fundamental link not only for the development

of our industry but for the whole country.

Por ello, contar con un periodo de transición

que nos permita adecuarnos e instrumentar

las nuevas condiciones pactadas en la Reforma

Energética, es fundamental, para que no se

ponga en riesgo ni la proveeduría de parte de

Pemex a sus clientes, ni la viabilidad de los

negocios de las empresas que hemos sido

clientes de Pemex por décadas.

A lo largo del segundo semestre del 2016,

ambas asociaciones conformamos una postura

de negociación en esta materia, misma que

fue compartida para su aprobación con todas

las empresas socias, alcanzando un consenso

hacia finales del cuarto trimestre del año.

De esta forma, ambas asociaciones

presentamos la posición oficial de la industria

química, en el caso de ANIQ en la Secretaría

de Economía, mientras que en el caso de

CEFIC a los representates de la Unión Europea

responsables de la negociación.

En materia de logística, la Asociación tuvo

una intensa sinergia dentro del desarrollo de la

normatividad, en este sentido nuevamente se

destacó la participación dentro de los diversos

grupos representados por la Secretaría de

Comunicaciones y Transportes, y en el cual

la ANIQ estableció un papel importante en la

elaboración y revisión del marco normativo, con

el firme propósito de incrementar la seguridad y

la competitividad en el transporte.

Congruente con este objetivo se participó

en los foros de consulta del Senado de la

República, para evitar la prohibición de los

vehículos doblemente articulados, y para ello

propusimos reforzar las medidas de seguridad

de estos vehículos.

En materia de comercio exterior, destaca

lo referente a la negociación México – Unión

Europea, en donde la Asociación inició

acercamientos con su contraparte en Europa

(CEFIC), con el objetivo de alcanzar un acuerdo

conjunto para establecer una propuesta de

flexibilización de las reglas de origen para la

industria química en el marco del tratado.

So to have a transition period that allows us to adapt and implement the new conditions agreed upon in the Energy Reform is absolutely fundamental, so that neither Pemex’s supplies to its customers, nor the viability of business conducted by firms which have for decades been Pemex’s customers, be in any way jeopardized.

In terms of foreign trade, and in particular the Mexico-European Union negotiation, the Association made initial approaches with its counterpart in Europe (CEFIC) to reach a joint agreement to establish a proposal to make the rules of origin more flexible for the chemical industry.

Throughout the second half of 2016, both associations took a negotiating stand on this matter which was shared with all member companies for their approval, reaching a consensus towards the end of the fourth quarter of the year.

In this manner, both associations presented the chemical industry’s official stand: ANIQ to the Ministry of Finance, CEFIC to the European Union representatives responsible for the negotiation.

In terms of logistics, the Association had an intense synergy in the development of regulations, once again taking part in the diverse groups represented by the Ministry of Communications and Transport, and establishing a key role in setting up and revising the regulatory framework, with the firm intention of increasing security and competitiveness in transportation.

Por su parte, el Instituto para la Competitividad de la Industria Química (ICIQ), capacitó a un total de 1,444 personas, 1,159 físicamente en el ICIQ y 285 en las plantas y corporativos, esta cifra se alcanzó a través de la impartición de 29 programas de capacitación que incluyen 5 Diplomados y 24 talleres o cursos, de modalidad abierta.

Por otra parte, la ANIQ realizó por encargo del programa LECBP “Low Emission Capacity Building Program” perteneciente al Programa de Naciones Unidas para el Desarrollo, el estudio denominado “Elementos hacia una estrategia de desarrollo bajo en emisiones para la industria química en México”.

A través de éste estudio, se logró estimar las emisiones de gases efecto invernadero (GEI) del sector al 2014, y mediante la proyección de crecimiento económico del sector al 2050, se logró generar la línea base de emisiones de GEI para el mismo periodo.

Para concluir, deseamos a todas las empresas socias, a la Comisión Ejecutiva y al Consejo Directivo por su invaluable apoyo, así como a los funcionarios de la Asociación por su compromiso incondicional para generar las condiciones de competitividad que la industria requiere para lograr nuestro anhelado desarrollo.

En materia ambiental, mención especial merecen los cambios en la ejecución de la evaluación de la conformidad relativos a la Verificación de la Emisión de Gases Efecto Invernadero.

En este sentido y en seguimiento a lo realizado durante 2015, atendimos los requisitos que solicita la PROFEPA a los organismos de evaluación de la conformidad, al tiempo que realizamos nuestras primeras verificaciones voluntarias en los sectores químico y minero.

Cabe destacar también que el Organismo de Certificación de la Asociación demostró el cumplimiento a los requisitos de competencia técnica al ser evaluado por la EMA en los Sectores de Energía y Procesos Industriales.

Con el objetivo de impulsar una cultura integral del reciclaje en la sociedad en general, a través de facilitar el acceso a una infraestructura itinerante para el acopio de residuos plásticos, nuestra Comisión de la Industria del Plástico, Responsabilidad y Desarrollo Sustentable (CIPRES), celebró por segunda ocasión su PLASTianguis,

En esta edición, el PLASTIanguis logró acopiar 1,428 kg de bolsas, botellas, envases desechables de poliestireno, productos de PVC y de polietileno, mismos que fueron recolectados y enviados a diferentes sitios especializados y autorizados para su reciclaje.

En materia de capacitación, nuestra Escuela de Capacitación en Brigadas de Emergencia (ECBE), continuó fortaleciendo su liderazgo, lo que le permitió capacitar durante 2016, a un

Consistent with this objective, we participated in the Mexican Senate’s consulting forums with a view to avoiding prohibition of dual-unit articulated vehicles. To this end, we suggested strengthening the safety measures of these vehicles.

As for the environment, the changes in making an assessment of conformity regarding Greenhouse Gas Emission tests deserve a special mention.

In this regard, and in keeping with what was done in 2015, we attended to PROFEPA’s requirements for conformity by test-conducting entities. At the same time, we conducted our first voluntary tests in the chemical and mining sectors.

It should also be noted that the Association’s Certification Body demonstrated compliance with technical competence requirements when it was evaluated by the EMA in the Energy and Industrial Processes Sectors.

To promote a comprehensive recycling culture in society in general by facilitating access to an itinerant infrastructure for the collection of plastic waste, our Plastic Industry Commission for Responsibility and Sustainable Development (CIPRES) held, for the second time, its PLASTianguis event.

This time around, the PLASTianguis managed to collect 1,428 kg of plastic bags, bottles, disposable polystyrene containers, PVC and polyethylene products, which were subsequently sent to diverse specialized sites authorized for recycling.

With regard to training, our Emergency Brigades Training School (ECBE) continued to strengthen its leadership, enabling it to train 3,629 people in 2016 in firefighting, attending to emergencies involving hazardous materials, and rescue from confined spaces, and diverse heights and/or depths.

The Institute for the Competitiveness of the Chemical Industry (ICIQ) trained a total of 1,444 people: 1,159 directly at ICIQ, and 285 in plants and corporations. They were trained through 29 training programs that included 5 Diploma courses and 24 open workshops or courses.

On the other hand, by order of the United Nations Development Program’s Low Emission Capacity Building Program (LECBP), ANIQ

carried out a study called “Elements towards a low emission development strategy for the chemical industry in Mexico.”

In this study we managed to estimate the greenhouse gas emissions (GHG) of the industry in 2014. Also, through the projection of the economic growth of the industry by 2050 it was possible to generate baseline GHG emissions for the 2014-2050 period.

In conclusion, we thank all member companies, the Executive Committee and the Board of Directors for their valuable support, as well as ANIQ officials for their unconditional support to create the conditions of competitiveness the industry requires to reach the desired goals.

seguridad de suministro de la industria y de

sus empresas proveedoras. De esta manera el

documento final fue publicado y los elementos

que componen la implementación del mercado

de gas natural son: acceso a información

suficiente, reserva de capacidad y acceso abierto

efectivo y competencia en las actividades de

comercialización (cesión gradual de contratos

de PEMEX).

Para cumplir con lo anterior, ciertas actividades iniciaron en 2016 y concluirán en 2017 como la temporada abierta para

reserva de capacidad en ductos nacionales y de internación e incluso actividades sin fechas concretamente previstas como la liberación de precios de venta de primera mano en zona norte y sur del País. Dada la relevancia del tema para el sector, se continuará siguiendo de cerca el tema en 2017 y se seguirá la participación en foros de consulta pública y reuniones con el gobierno federal, así como buscar posicionar la postura dentro del sector industrial.

During 2016, through the position developed

by ANIQ’s Energy Commission with the

participation of companies of different profiles

within the chemical industry, several projects

of the Federal government were addressed. The

most relevant are detailed below:

» Energy Reform: One of the

unquestionable issues related to the energy

reform and of high-impact for the chemical

industry that was addressed in 2016 was the

public policy for the implementation of the

natural gas market, presented in a document by

the Ministry of Energy (SENER) in coordination

with the Energy Regulatory Commission (CRE)

and the National Center for Natural Gas Control

(CENAGAS). ANIQ carried out a consultation

with member companies and during the public

consultation expressed comments intended

to strengthen a secure supply for the industry

and its suppliers. In this manner, the final

document was published and the elements that

make up the implementation of the natural gas

market are: access to sufficient information,

capacity reserve, effective open access, and

competition in commercialization activities

(gradual assignment of PEMEX’s contracts).

In order to comply with the above, certain

activities were started in 2016 that will

conclude in 2017 such as the open season

for capacity reserve in domestic and incoming

pipelines, and even activities without specific

dates such as the release of first-hand sales

prices in the North and South of the country.

Given the relevance of the issue for the

industry, this topic will continue to be closely

monitored in 2017 and participation in public

Norma de Emergencia de Especificaciones de Calidad de los Petrolíferos: Se concluyó y publicó la norma NOM-016-CRE-2016 sobre especificaciones de calidad de los petrolíferos, la participación de ANIQ en este proyecto fue para dar atención a los comentarios de los socios relacionados al uso de aditivos para los diferentes combustibles y la manera de dar cumplimiento a la oxigenación en gasolinas. De manera adicional, la norma en su artículo 6to. transitorio indicó la creación de un grupo de trabajo técnico a conformarse por los distintos sectores de la sociedad para atender temas relacionados con la norma en cuestión, por lo que seguirá este tema siendo de atención en las actividades para 2017.

Norma sobre las especificaciones de los petroquímicos básicos: Se concluyó y publicó la norma NOM-014-CRE-2016 sobre las especificaciones de calidad de los petroquímicos, indicando con ello la calidad que debe cumplir el etano, propano y la mezcla de butanos. Durante el transcurso de desarrollo de la norma se redujeron los petroquímicos sujetos a la regulación en calidad y se logró mantener la calidad que los socios estimaban pertinentes para sus operaciones.

Norma sobre el transporte de gas natural, etano, biogás y gas asociado al carbón mineral por medio de ductos: La Agencia Nacional de Seguridad Industrial y Protección al Ambiente en materia de Hidrocarburos (ASEA) retomó este proyecto donde la ANIQ fue un activo participante, el

documento se presentó a consulta pública durante 2016 bajo el título PROY-NOM-007-ASEA-2016 y se espera que la respuesta a comentarios, así como la publicación de la norma se alcance durante el primer semestre de 2017.

Norma sobre la distribución de gas natural: Al igual que el proyecto de transporte de gas natural, la Agencia Nacional de Seguridad Industrial y Protección al Ambiente en materia de Hidrocarburos (ASEA) retomó este proyecto con la participación de diversos actores, incluido la industria química a través de la ANIQ. El proyecto se presentó a consulta pública como PROY-NOM-003-ASEA-2016 y se espera que la respuesta a comentarios, así como la publicación de la norma se alcance durante el primer semestre de 2017.

Guillermo I. García Alcocer.

De manera adicional, durante el año se realizaron eventos de capacitación enfocados en actualizar a los representantes de empresas socias de ANIQ, sobre los requerimientos legales en materia energética.

» National Consultative Standardization

Committees: During 2016 ANIQ’s energy

division continued its participation in the

Standardization Committees of the Energy

Regulatory Commission, the Safety, Energy and

Environmental Agency. The progress achieved

in every project is described herein below:

Emergency Standard on the Quality Specifications of Products obtained from oil refining or natural gas processing

activities (petroliferous products): The

NOM-016-CRE-2016 standard on the quality

of petroliferous products was completed and

published. ANIQ’s participation in this project

consisted in taking note of the comments

made by member companies regarding the use

of additives for the various fuels and how to

comply with oxygenation in gasolines. Also,

in its sixth transitory article, the standard

sets up the need to create a technical working

group with the participation of different sectors

of society to address issues related to the

standard in question. Therefore, this topic will

continue to be addressed in the 2017activities.

Standard on the specifications of

basic petrochemicals: The NOM-014-

CRE-2016 standard on petrochemical quality

specifications was finalized and published,

stating the quality requirements to be met by

ethane, propane and the mixture of butanes.

During the development of the standard, the

number of petrochemical products that were

subject to quality regulations decreased.

However, the quality that member companies

considered relevant for their operations was

maintained.

Standard on the pipeline transportation of natural gas, ethane, biogas and gas

associated to mineral coal: The Mexican

Industrial Safety and Environmental Protection

Agency on Hydrocarbon Matters (ASEA)

resumed work on this project where ANIQ had

been an active participant. The document was

submitted for public consultation in 2016 under

the title PROY-NOM-007-ASEA-2016, and it is

expected that the response to comments made

as well as the publication of the standard will

be achieved during the first half of 2017.

Durante 2016, la ANIQ a través de la coordinación del área de energía, realizó por encargo del programa LECBP “Low Emission Capacity Building Program” perteneciente al Programa de Naciones Unidas para el Desarrollo (PNUD) el estudio “Elementos hacia una estrategia de desarrollo bajo en emisiones para la industria química en México” con lo que se logró estimar las emisiones de gases efecto invernadero del sector al 2014 y mediante la proyección de crecimiento económico del sector al 2050 se logró generar la línea base de emisiones de GEI para el mismo periodo. De manera adicional, el proyecto fue consultado con líderes de la industria a través de talleres en

que se mostraron los avances de los 5 capítulos que componen el estudio, así también se atendieron las solicitudes del Instituto Nacional de Ecología y Cambio Climático (INECC) para aprobar los resultados del mismo. El resultado final del trabajo se presentará en un evento en 2017 con la participación del INECC, PNUD y empresas afines.

Natural Gas Distribution Standard: Like

the transportation project of natural gas, the

Mexican Industrial Safety and Environmental

Protection Agency on Hydrocarbon Matters

(ASEA) resumed this project with the

participation of various stakeholders, including

the chemical industry represented by ANIQ. The

project was presented for public consultation

as PROY-NOM-003-ASEA-2016 and it is

expected that the response to comments made

as well as the publication of the standard will

be achieved during the first half of 2017.

In 2016, for the second year, the Energy

division held the Energy Day an event that

took place during the month of July with

the participation of 60 representatives from

companies in the chemical and related

sectors. During the development of the event,

representatives of the Ministry of Energy,

the private sector, and PEMEX were present,

and the event was closed by the Chairman

Commissioner of the Energy Regulatory

Commission, Mr. Guillermo I. García Alcocer.

During 2016, ANIQ, through the

coordination of the energy division, was

entrusted by the “Low Emission Capacity

Building Program”, (LECBP) of the United

Nations Development Program (UNDP), a study

called: “Factors for a low emission development

strategy for the chemical industry in Mexico”.

With this study ANIQ was able to estimate

the greenhouse gas emissions of the chemical

industry as of 2014, and through the forecast

of the economic growth of the industry to

2050, the baseline of GHG emissions was made

for that period. Additionally, this project was

shared with industry leaders through several

workshops showing the progress of the five

chapters included in the study. Furthermore,

the request made by the National Institute

of Ecology and Climate Change (INECC) to

approve the results obtained was met. The final

version of this work will be presented at an

event in 2017 with the participation of INECC,

UNDP and related companies.

mexicana, el inicio de negociaciones

comerciales entre ambos países ha generado

una expectativa de integración y crecimiento

comercial, por lo que la ampliación del universo

de productos contenidos en el ACE 53 ha sido

una de las prioridades de la ANIQ durante el

2016.

T he commercial flow of the chemical industry between Mexico and Brazil is undoubtedly relevant and may be substantially

increased by reaching trade integration and

trade facilitation agreements that will allow

the elimination of tariffs between these two

nations, thus giving greater dynamism to the

customs clearance of products.

The starting of trade negotiations between

the two countries has generated great

expectations of commercial growth and

integration in the companies of the Mexican

chemical industry. In this manner, the

expansion of the product universe included in

the Economic Complementation Agreement

No. 53 became one of ANIQ’s priorities in

2016.

Como resultado de esta iniciativa ANIQ ha buscado la incorporación de más de 1,900 fracciones arancelarias, mientras que para Brasil este esfuerzo de integración ha sido también relevante, toda vez que México ha recibido la solicitud para incluir en el mismo acuerdo un universo mayor a las 1,600 fracciones arancelarias de la industria química Brasileña.

En el 2016 se celebraron 5 rondas de negociación, a través de las cuales la industria química logró alcanzar un acuerdo para aproximadamente el 80 por ciento de los productos solicitados, tanto en acceso a mercados (eliminación arancelaria) como en reglas de origen.

Adicionalmente, la ANIQ promovió acuerdos sustanciales en materia de solución de diferencias, con el objetivo contar con instrumentos que le den certidumbre jurídica a las empresas que utilicen el acuerdo y se fomente con ello la integración regional.

Ambos países acordaron continuar con el proceso de negociación, buscando concluirlo y ponerlo en vigor hacia finales de 2017 o principios del 2018.

El Gobierno Federal a través de la Secretaría de Economía dio inicio a un proceso de negociación para la revisión y eventual adecuación del Tratado de Libre Comercio que México tiene en vigor con los países que conforman a la Unión Europea.



As a result of this initiative, ANIQ has been trying to incorporate more than 1900 tariff items, and this integration effort has also been very relevant for Brazil since Mexico has received a request to include in this agreement a universe larger than the 1600 tariff items of the Brazilian chemical industry.

Five rounds of negotiations were held in 2016 through which the chemical industry managed to reach an agreement for almost 80 per cent of the products requested, both concerning market access (tariff elimination) and rules of origin.

Additionally, ANIQ promoted substantial agreements on dispute resolution matters aiming at having the instruments to give legal certainty to the companies using this agreement, thus promoting regional integration.

Both countries agreed upon going forward with the negotiation process in an attempt to complete it so that it can become effective by the end of 2017 or the beginning of 2018.

The Federal government through the Ministry of Economy started a negotiation process for the revision and eventual adaptation of the Free Trade Agreement in effect between Mexico and the countries of the European Union.

By the end of 2016, the Federal Government held the first round of negotiations to agree on exploring the possibility to modernize,

The chapters subject to negotiation are: origin, market access, services and investment, legal framework, trade facilitation, intellectual property, technical barriers to trade, sanitary measures, and energy, among others.

All negotiation tables had an exploratory nature up to the closing of 2016. The original texts giving rise to the Free Trade Agreement were reviewed and several proposals were submitted by every country to complement the Agreement adapting it to current needs of all the economies.

On market access matters, in this renegotiation the need to include products that were originally excluded from the agreement was established. These products include several highly sensitive products mostly pertaining to the agricultural and fisheries sectors, as well as cereals and dairy products. Industrial goods that include chemical products are included in the agreement with reciprocal zero tariffs.

With respect to the negotiation of criteria and rules of origin, the countries agreed upon identifying sensitivities and improvement processes in accumulation and certification criteria, and the renegotiation of rules of origin for sensitive products.

On these matters, ANIQ completed a wide consultation among member companies and submitted a proposal to the Ministry of Economy to amend and adapt the rules of origin, precisely including the criteria agreed upon with the European Union, in such a way that Mexican exporters comply with the same origin criterion.

Thus, in the framework of the aforementioned agreement, and as a result of the agreements reached at the meetings of the Foreign Trade Commission, ANIQ started approaching CEFIC, its counterparty in Europe, aiming at reaching a joint agreement to set up a proposal to make the rules of origin more flexible for the chemical industry.

In the second half of the year, ANIQ and CEFIC prepared a negotiation position on these matters, which position was shared for approval with all member companies, reaching a consensus by the end of the fourth quarter.

In this manner, these bodies submitted the official position of the chemical industry. ANIQ submitted it to the Ministry of Economy, and CEFIC submitted it to the representatives of the European Union in charge of these negotiations.

The Federal Government through the Ministry of the Economy started to review, modernize and adapt the Free Trade Agreement that Mexico has in effect with the countries of the European Free Trade Association, that is Norway, Liechtenstein, Switzerland and Iceland.

la cual considera exactamente los mismos

criterios acordados con la Unión Europea, de tal

forma que los exportadores mexicanos tengan

que cumplir con un mismo criterio de origen.

Al termino de las negociaciones en el

2016, se acordó continuar con el proceso de

negociación entre las diferentes autoridades

y con la consulta contínua con la Industria

Química en cada país de tal forma que hacia el

primer trimestre de 2017 pueda agendarse una

nueva ronda de negociaciones y eventualmente

concluir el proceso hacia finales del 2017.

diáLogo Químico eN eL FoRo de coopeRAcióN ecoNómicA de AsiA pAcíFico (Apec)

A lo largo de 2016 La Asociación participó

en todas las reuniones del Diálogo Químico de

APEC, con el objetivo de definir e instrumentar

los objetivos estratégicos de este grupo para

el bienio 2017 – 2019 los cuales atienden las

principales preocupaciones de la industria en el

ámbito internacional.

Estos objetivos estrategicos tienen la finalidad de:

» Promover la alineación de las metas de crecimiento económico de APEC con la facilitación del Comercio.

» Promover una actividad regulatoria que facilite el comercio, mientras protege la salud de las personas y el medio ambiente.

Al cierre del 2016 el Gobierno Federal sostuvo una primera ronda de negociación en la cual se acordó explorar la posibilidad de modernizar, flexibilizar y en su caso adecuar las Reglas de Origen Específicas vigentes en el tratado y realizar un intercambio de propuestas sobre dicha flexibilización.

Para ello y como resultado de los acuerdos alcanzados en las reuniones de la Comisión de Comercio Exterior, ANIQ inicio acercamientos con su contraparte en Europa (CEFIC) con el objetivo de alcanzar un acuerdo conjunto para establecer una propuesta de flexibilización de las reglas de origen para la industria química en el marco del Tratado arriba mencionado.

A lo largo del segundo semestre del año, ANIQ y CEFIC conformaron una postura de negociación en esta materia, misma que fue compartida para su aprobación con todas las empresas socias, alcanzando un consenso hacia finales del cuarto trimestre del año.

De esta forma, ambos organismos

presentaron la posición oficial de la industria

química, en el caso de ANIQ en la Secretaría

de Economía, mientras que en el caso de

CEFIC a los representates de la Unión Europea

modernización del Acuerdo de Asociación económica entre méxico y (eFTA)

El Gobierno Federal a través de la Secretaría

de Economía inicio la revisión, modernización

y adecuación del Tratado de Libre Comercio

que México tiene en vigor con los países

que conforman La Asociación Europea de

Libre Comercio, conformada por Noruega,

Liechtenstein, Suiza e Islandia.

Los capítulos objeto de la negociación,

son Origen, Acceso a Mercados, Servicios

e Inversión, Marco Legal, Facilitación del

Comercio, Propiedad Intelectual, Obstáculos

Técnicos al comercio, Medidas Sanitarias,

Energía entre otros.

Todas las mesas la negociación tuvieron

hasta el cierre de 2016 un carácter exploratorio,

se revisaron los textos originales con los

cuales nació el Tratado de Libre Comercio y se

expusieron las diferentes propuestas que cada

país tiene para complementar el tratado a las

necesidades actuales de todas las economías.

En materia de Acceso a Mercados en esta

nueva renegociación se ha establecido la

necesidad de incorporar los productos que

originalmente quedaron excluidos del tratado

por ser altamente sensibles y los cuales en su

mayoría pertenecen al sector agrícola, pesquero,

de cereales y lácteos, toda vez que los bienes

industriales entro de los cuales se clasifican

los productos químicos están incluidos en el

tratado con aranceles en cero recíprocos.

En lo que respecta a la negociación de

criterios y reglas de origen se acordó entre los

paises identificar sensibilidades y procesos

de mejora en criterios de certificación,

acumulación y la renegociación de reglas de

origen para productos sensibles.



By the end of the negotiations in 2016, the participants agreed to continue with this negotiation process with the various authorities involved and with an on-going consultation with the Chemical Industry of every country so that by the end of the first quarter of 2017 a new round of negotiations could be scheduled to eventually complete this process by the end of 2017.

chemicAL diALog AT The AsiA-pAciFic ecoNomic coopeRATioN FoRum (Apec)

Throughout 2016, ANIQ took part in all the meetings of the APEC Chemical Dialog aiming at defining and implementing the strategic objectives of the group for the 2017-2019 period, mainly addressing the major concerns of the chemical industry in the international arena.

The purpose of the strategic objectives are:

» To promote the alignment of APEC’s economic growth goals with trade facilitation.

» To promote regulatory activities facilitating trade while protecting people’s health and the environment.

» To promote the responsible management of chemical products throughout its full life cycle.

» To identify any barrier to the use of chemical products and the processes to promote sustainable solutions.

» To strenghten the position of the chemical industry around the world as a supplier of solutions to address the serious problems the world faces, such as climate change.

Químico estableció propuestas en materia de

de los Tratados de Libre Comercio en la región,

así como la iniciativa de avanzar hacia una

región de libre comercio en Asia Pacífico

(FTAAP).

Estas iniciativas continuarán su desarrollo y

eventual implementación hacia el bienio 2017

- 2019.

pRoyecTo de compAcTAcióN de LA Tigie

Durante el 2016 la Asociación Nacional

de la Industria Química, en conjunto con

la Secretaría de Economía trabajó en un

proyecto para la instrumentación de la sexta

enmienda y en la continuidad de la iniciativa

de compactación de la ley de los Impuestos

Generales de Importación y Exportación que

involucró todo el universo arancelario de la

industria química.

» Promover el manejo responsable de los productos químicos a lo largo de su ciclo de vida.

» Identificar las barreras para utilizar productos químicos y procesos que favorezcan soluciones sustentables.

» Fortalecer globalmente la posición del sector químico como un proveedor de soluciones para atender los grandes problemas que aquejan al mundo, como lo es el cambio climático.

A través del cumplimiento de estos objetivos,

las economías de APEC buscamos alcanzar tres

metas específicas:

» Facilitar el comercio y promover la cooperación regulatoria y el reconocimiento mutuo.

» Promover el reconocimiento de la industria química como un proveedor de soluciones para alcanzar un crecimiento económico, ambiental y social sustentable.

» Garantizar la efectiva cooperación entre la industria química y los gobiernos para mejorar el manejo adecuado de los productos químicos.

De esta forma, ANIQ en conjunto con las

economías miembros de APEC, realizó un

análisis de las mejores prácticas en torno a la

facilitación del comercio en la industria química

y posterioremente las metodologías para su

implementación en México y la región.

Se analizaron temas fundamentales para la

facilitación del comercio en la industria química

como lo es la autocertificación, los avances en

la implementación del GHS y el control de las

regulaciones a productos químicos.



In these categories, the Chemical Dialog

set up several proposals on trade facilitation

matters, development and promotion of Free

Trade Agreements in the region, as well as a

new initiative towards reaching a free trade

region in Asia Pacific (FTAAP).

The development of these initiatives will

continue until their eventual implementation

in the 2017 – 2019 period.

geNeRAL impoRT ANd expoRT duTy TARiFF LAw, Tigie’s coNdeNsATioN pRojecT

During 2016, the National Association of the

Chemical Industry, together with the Ministry

of Economy worked in a project to implement

the sixth amendment and the continuity of the

condensation initiative for the General Import

and Export Duty Tariff Law involving all the

tariff items universe of the chemical industry.

The purpose of this project was to include in

the law all the amendments made by the World

Customs Organization on the matters of the

Chemical Industry, and at the same time to

condensate the number of tariff items included,

aiming at trade facilitation and reduction of risk

in tariff item classification.

In the setting of these condensation efforts,

it was agreed with the Ministry of Economy to

carry out these changes only for those tariff

items recording minimum trade, that is, less

than one million US dollars a year, and for

them to keep the same tariff and non-tariff

restrictions and regulations.

Through the compliance with these

objectives, the APEC economies intend to

reach three specific goals:

» To facilitate trade and promote regulatory cooperation and mutual recognition.

» To promote the recognition of the chemical industry as a provider of solutions to reach sustainable economic, environmental and social growth.

» To ensure an effective cooperation between governments and the chemical industry to improve the adequate handling of chemical products.

In this manner, ANIQ jointly with the

economies members of APEC, carried out an

analysis of the best practices in trade facilitation

for the chemical industry and subsequently,

the methodologies for their implementation in

Mexico and the region.

Fundamental topics were analyzed for trade

facilitation in the chemical industry, such as

self-certification, the progress made in the

implementaion of the GHS, and control of

regulations for chemical products.

Additionally, relevant agreements were

reached on topics such as:

» Regional economic integration

» Regulatory cooperation

» Trade facilitation

» Implementation of the GHS

» A new initiative: “Sustainable Chemical Industry”

Cabe destacar que simultáneamente al

proceso de compactación se trabajó en la

apertura a 10 dígitos para las fracciones que por

sus características especiales así lo requirieron.

El resultado de estos trabajos se presentará

a la Cámara de Diputados para su aprobación

durante los primeros meses de 2017 y se espera

que la publicación de la nueva TIGIE (Tarifa de

Ley de Impuestos Generales de Importación y

Exportación) se presente durante ese mismo

año.

pRogRAmA de coNTRoL AduANeRo y de FiscALizAcióN

La apertura comercial, la integración regional

y la defensa del mercado doméstico contra

las prácticas desleales e ilegales de comercio

continúan siendo parte fundamental de los

objetivos establecidos por la Asociación.

La Asociación en conjunto con la

Administración General de Aduanas

instrumentamos una serie de acciones,

controles y mecanismos correctivos para

combatir el contrabando, el dumping y la

subvaluación de productos químicos.

Lo anterior, se lleva a cabo a través de uno de

los programas de trabajo conjunto más exitosos

en materia de comercio exterior, el Programa

de Control Aduanero y de Fiscalización.

Este proyecto tuvo como objetivo incorporar

a la Ley todas las modificaciones realizadas

por la Organización Mundial de Aduanas en

materia de la Industria Química y al mismo

tiempo, compactar el número de fracciones

arancelarias que la componen, buscando con

ello facilitar el comercio y reducir el riesgo en la

clasificación arancelaria.

En el marco de estos trabajos de

compactación, se acordó con la Secretaría de

Economía realizar estas modificaciones sólo en

aquellas fracciones que registraran un comercio

mínimo, es decir, inferiores a un millón de

dólares americanos al año y que mantuvieran

el mismo arancel y las mismas regulaciones y

restricciones no arancelarias.

Como resultado de esta iniciativa, ANIQ

durante el último trimestre del año, dio a

conocer en consulta pública toda la iniciativa

de cambios que sufrirían las fracciones

arancelarias en los capítulos que corresponden

al universo químico:

» Capítulo 27 Combustibles minerales, aceites minerales y productos de su destilación

» Capítulo 28 Químicos inorgánicos

» Capítulo 29 Químicos orgánicos

» Capítulo 31 Abonos

» Capítulo 32 Pigmentos y Colorantes

» Capítulo 34 Agentes de superficie orgánicos, preparaciones para lavar, preparaciones lubricantes, ceras artificiales, ceras reparadas, productos de limpieza

iNspecTioN ANd cusToms coNTRoL pRogRAm

Trade liberalization, regional integration and

the defense of the domestic market against

unfair and illegal trade practices continue to be

a fundamental part of the objectives set up by

the Association.

ANIQ, together with the Customs General Administration, implemented a series of actions, controls and corrective mechanisms to fight smuggling, dumping and the undervaluation of chemical products.

This is carried out through one of the most successful joint work programs on foreign trade matters: the Customs Control and Inspection Program.

This program is coordinated by the Central Administration of Customs Investigation (ACIA) and its purpose is to promote an active

participation of the industry in the denunciation of smuggling and unfair practices identified by companies in their various markets.

Throughout 2016, ANIQ filed a series of

formal complaints of origin triangulation,

undervaluation, inaccurate tariff classification,

and non-compliance with non-tariff restrictions

and regulations, mainly in the sectors of

inorganic chemical products, resins and rubber.

As a result of these efforts and of the constant monitoring carried out by this Central Administration, tax liabilities were determined for more than 8 million pesos, pending only the final inspection actions by the authorities.

In like manner, the companies implementing illegal practices of this kind were eliminated from the General Importers’ Register, therefore preventing their products from entering into Mexico under illegal import conditions.

As a result of this initiative, ANIQ disclosed

in a public consultation in the last quarter of

the year, all the changes applicable to the tariff

items in the chapters of the chemical universe:

» Chapter 27 Mineral fuels, mineral oils and distillation products

» Chapter 28 Inorganic Chemicals

» Chapter 29 Organic Chemicals

» Chapter 31 Fertilizers

» Chapter 32 Pigments and Dyes

» Chapter 34 Organic Surface Agents, washing preparations, lubricant preparations, artificial wax, repaired wax, cleaning products

» Chapter 35 Adhesives

» Chapter 38 Several products of the Chemical Industry

» Chapter 39 Resins.

» Chapter 40 Synthetic Rubber

It must be pointed out that, simultaneously

to the condensation process, work was carried

out to expand to 10 digits the tariff items that

due to their special features so required.

The results of this work will be submitted

to the Chamber of Deputies for approval over

the first months of 2017, and the publication

of the new TIGIE (General Import and Export

Duty Tariffs Law) is expected to be some time

this year.

Este programa es coordinado por la Administración Central de Investigación Aduanera (ACIA) con la finalidad de que la industria participe activamente en la denuncia de prácticas de contrabando y desleales que las empresas puedan identificar en sus diferentes mercados.

A lo largo del 2016, ANIQ presentó una serie de denuncias por triangulación de origen, subvaluación, inexacta clasificación arancelaria, e incumplimiento en regulaciones y restricciones no arancelarias, principalmente en los sectores de productos químicos inorgánicos, resinas y hule.

Como resultado de estos trabajos y del constante monitoreo realizado por esta Administración se determinaron créditos fiscales por más de 8 millones de pesos, esperando tan solo el acto final de fiscalización por parte de la autoridad.

Asimismo se procedió con la baja en el Padrón General de Importadores a las empresas que realizaron este tipo de prácticas ilegales, evitando con ello que sus productos continúen ingresando al país en condiciones de importación ilegal.

seRvicio de pRevALidAcióN eLecTRóNicA de pedimeNTos “pRevALidAdoR ANiQ”

La Asociación Nacional de la Industria Química continuó con su compromiso de ofrecer a las empresas un servicio de prevalidación electrónica de pedimentos con los más altos estándares de calidad.

En este año, se logró obtener por parte de la Administración General de Aduanas la renovación de la autorización para operar este sistema por 5 años más.

Como resultado de los trabajos para obtener esta nueva autorización, se realizaron importantes inversiones en tecnología y equipo de última generación y alto rendimiento, por lo que hoy ANIQ cuenta con nuevos y mejores servidores que trabajan en paralelo en su Data Center principal y con enlaces redundantes a Internet y al Servicio de Administración Tributaria (SAT) así como servidores adicionales en un Data Center alterno.

Lo anterior nos permite garantizar que el sistema opere con los mejores estándares calidad en el envío y recepción de la información

contenida en los pedimentos, además de contar con un sistema de seguridad y confidencialidad de la información.

El Prevalidador de la ANIQ, también ofrece un esquema de contingencia robusto para garantizar el servicio, así como soporte normativo y técnico las 24 horas del día y los 7 días de la semana es decir que cuenta con horarios de oficina y de guardia para proporcionar el servicio continuo y asesoría técnica los 365 días del año.

En este año iniciamos la promoción de un nuevo servicio, conocido como “Repositorio de Expedientes Electrónicos” a través del cual las empresas tendrán la posibilidad de resguardar su información electrónica de comercio exterior, es decir, sus expedientes completos y tenerla disponible por el periodo de 5 años establecido por la autoridad, todo en un mismo lugar conectado con el portal del prevalidador y con la posibilidad de guardar en la nube toda clase de documentación que permita el soporte de las operaciones de comercio exterior realizadas.



eLecTRoNic pRe-vALidATioN seRvice oF cusToms decLARATioNs “ANiQ’s pRe-vALidATioN sysTem”

The National Association of the Chemical Industry continued with its commitment to offer member companies an electronic pre-validation service of customs declarations with the highest quality standards.

ANIQ obtained this year the renewal from the General Customs Administration of the authorization to operate this system for 5 more years.

As a result of the efforts to obtain this new authorization, major investments were made in last generation, high performance technology and equipment, so that ANIQ has now the best and most recent servers running in parallel with its main Data Center, with redundant links to Internet and to the Tax Administration Service (SAT), as well as additional servers at an alternate Data Center.

The aforementioned allows ANIQ to ensure that this system will operate according to the highest quality standards sending and receiving the data included in customs declarations, having an information security and confidentiality system.

ANIQ’s Pre-validation System also offers a robust contingency scheme to ensure the service, as well as technical and regulatory support 24 x 7, that is, it runs during working hours with a guard duty to provide ongoing services and technical advice 365 days a year.

The promotion of a new service known as “Electronic Files Repository” was started in 2016. Through this service, member companies will be able to back up their foreign trade electronic information, that is, their full files, having them available for the 5-year period set up as mandatory by the Mexican authorities. All documents will be located in one place connected to the Pre-validation portal, with the possibility of storing in the cloud all kinds of documents to support their foreign trade transactions.

A través de distintos eventos, la ECBE, continuó fortaleciendo su liderazgo en materia de capacitación de alta calidad, lo

Durante el año 2016, entre cursos abiertos y cerrados, la ECBE registró un total de 3,629 personas que se entrenaron en distintas áreas distinguiéndose por volumen de asistencia; en primer lugar, se distinguió el área de combate de incendio, seguida por la de atención de emergencias con materiales peligrosos y en tercer lugar rescate en espacios confinados y alturas en sus distintos niveles de profundidad.

Legislación

Durante el año a reportar, diferentes propuestas legislativas fueron promovidas, tanto a nivel federal como a nivel local, destacando:

» Propuesta de modificación de la Ley General para la Prevención y Gestión Integral de Residuos. para prohibir el EPS.

A principios del 2016 en el Senado se promueve modificar la Ley con el objetivo de sustituir o en su caso prohibir al poliestireno expandido (PS) mejor conocido como unicel.

» Taller código de cianuro

Con el apoyo del Instituto Internacional del Código de Cianuro, ECBE se alió para realizar por primera vez éste taller que se realizó del 20 al 21 de junio.

Los participantes pudieron conocer de primera mano la aplicación del Código y sus consideraciones de seguridad que son aplicables al manejo de éste producto en distintas operaciones productivas.

for the first time, on June 20 and 21, this

Legislation

During 2016, a number of different legislative

proposals were put forward, both at the federal

level as well as the local level, namely:

» Proposal to amend the General Law for Prevention and Integral Management of Waste, so as to ban EPS.

In early 2016 a draft was proposed in the

Senate to amend this Law so as to replace or

even prohibit expanded polystyrene (PS), better

known as Unicel.

In the 2016 edition, the firms whose

Esta temporada consistió en fortalecer los principios de una cultura más responsable con el medio ambiente, fomentando acciones de reducción, reúso, reciclaje y reforestación entre otras.

CIPRES realizó divertidas actividades orientadas al público infantil para conocer los beneficios que ofrece el uso del plástico y su manejo responsable al momento de su deshecho, de manera particular se les mostraron diversos artículos elaborados con poliestireno como un marco fotográfico de “unicel”, esta dinámica se realizó gracias al apoyo de las empresas Marcos & Marcos y Dart de México (socios CIPRES).

“pLAsTianguis 2016”

Con el objetivo de impulsar una cultura integral del reciclaje en la sociedad en general, a través de facilitar el acceso a una infraestructura itinerante para el acopio de residuos plásticos, CIPRES y sus empresas socias llevaron a cabo por segunda ocasión su PLASTianguis,

» Iniciativa para reformar la Ley General para la Prevención y Gestión Integral de los Residuos en materia de reciclaje.

De nueva cuenta el poliestireno era blanco de otra regulación mediante la ley de residuos, en esta ocasión para promover el reciclaje de este material, iniciativa que se basaba en desmitificar la imposibilidad de reciclar dicho material.

» Reforma de la Ley de Residuos Sólidos del Distrito Federal

La Asamblea Legislativa de la Ciudad de México no se quedó atrás en materia legislativa, por lo que a finales del 2016, promovió una iniciativa cuyo objeto era incentivar la separación de los residuos sólidos de la Ciudad de México, mediante la aplicación de “cuotas de recuperación” a la ciudadanía que no separe sus residuos.

Derivado de lo anterior, CIPRES se avocó a atender estas iniciativas y dada la solidez y veracidad de la información presentada de manera oportuna, permitió que estos proyectos no fuesen dictaminados, evitando con ello cualquier posibilidad de afectar los intereses de nuestro sector de plásticos.

La pandilla cipRes en Kidzania cuicuilco (ciudad de méxico)

Como parte del compromiso de la Comisión con la promoción de una cultura del manejo adecuado de residuos plásticos. La Pandilla CIPRES participó durante el mes de abril en la temporada de Greener World “Niños por un Mundo + Verde” en KidZania Cuicuilco.

Durante el evento se contó con el apoyo de las autoridades de la delegación Cuauhtémoc en la Ciudad de México, lo que le permitió realizar este magno evento en la explanada del Monumento a la Revolución.

De nueva cuenta, la dinámica fue invitar a la población para que entregara sus residuos plásticos para que les fueran intercambiados, (mediante la aplicación del principio de la valorización de residuos), por productos de canasta básica empacados en materiales plásticos.

El Diplomado en plásticos se llevó a cabo entre los meses de junio a septiembre con una duración de 108 horas distribuidas 6 módulos, cubriendo un amplio panorama sobre plásticos,




CIPRES held fun activities for children to learn about the benefits of using plastic and the responsible handling of it at the time of its disposal. In particular, children were shown different articles made of polystyrene, such as a photograph frame made of “styrofoam.” The firms Marcos & Marcos and Dart de México (CIPRES partners) enabled this event.

“pLAsTianguis 2016”

To promote an integral culture of recycling in society in general, by facilitating access to an itinerant infrastructure for the collection of plastic waste, CIPRES and its partner companies held their PLASTianguis market for a second time.

During the event, CIPRES had help from the authorities of Mexico City’s Cuauhtémoc precinct, which allowed this magnum event to be held on the square in front of the Monument to the Revolution.

Once again, the idea was to invite people to hand over their plastic waste in exchange (by applying the principle of waste recovery) for food staples packed in plastic materials.

In this edition, the PLASTianguis managed to collect 1,428 kg of bags, bottles, disposable polystyrene containers, PVC and polyethylene products, which were collected and sent to different authorized specialized places for recycling.

The diploma course in plastic was held between June and September with a duration of 108 hours distributed over 6 modules.

Again, polystyrene was the target of another regulation by way of the law for wastes, this time to promote recycling of this material. This initiative was based on demystifying the impossibility of recycling this material.

» Reform of the Mexico City Federal District Solid Wastes Law

The Mexico City Legislative Assembly was not dragging its feet either in legislative matters, and at the end of 2016 drafted an initiative aimed at encouraging the separation of Mexico City solid waste by applying “salvage charges” to citizens who do not separate their waste.

In view of the above, CIPRES promised to attend to these bills and, given the reliability of the information submitted in a timely fashion, prevented this draft from becoming law, thereby preventing any chance of the interests of our plastics sector being affected.

The cipRes gang in Kidzania cuicuilco (mexico city)

As part of the Commission’s commitment to promoting a culture for the proper management of plastic waste, in April the CIPRES Gang participated in the Greener World season “Niños por un Mundo + Verde” in KidZania Cuicuilco.

This season consisted of strengthening the principles of a more responsible attitude to the environment, encouraging moves to reduce, re-use, recycle and reforest, among others.
